Default notice problem

Hello all

 

I have a default notice which I believe is invalid due to the 14 days to pay being from the date of the notice not service.

 

However they sent the default notice on 21/03/07 but did not terminate the account until 04/04/07.

 

Is the default notice still invalid? My complaint is at present with the FSO. What would I be entitled to claim due to the invalid default notice? Were the bank only allowed the arrears or the whole amount as they didn't terminate the account until a couple of weeks after the default notice or does this not matter?

 

I would be grateful for some clarity as I don't know whether to inform the FOS of this. Thanks

when did you take out the agreement, was it a card? have you got a copy of the agreement can u post it up

 

do not make any payments to them and do not write to them or acknowledge any letters]]

 

what is your complaint to fos about

I took out a loan with Abbey in 2006. I got into difficulties in december 2007 and through the CAB set up a payment schedule of 51 per month. This continued until Abbey cancelled the direct debit and I could not pay anything because the account was in 'limbo', waiting to be sold on to another dca. It has been like this since September 2008. I wrote to the Ombudsman because I couldn't make payments and wanted to clear the account so I could repair my credit rating.

 

I have been told that the dca should be writing to me any day now to recommence payments. I do not have a copy of the agreement and have not CCA'd or SAR'd the account yet as I am waiting for the dca to get in touch.

 

It is only very recently that I have found out about faulty default notices so I would like the Ombudsman to add this to my original complaint. Can I do this or would I have to address this separately?
