Good morning everyone, I'm not sure if I should post here in new thread or in my original post, but need to make sure it is seen, please feel free to correct me.

I sent a CPR 31.14 request (I do hope that was correct) to the above bunch, it was delivered and signed for on 13th July, the 7 days I gave them (from template) to ask for more time or supply docs, is now up.

 

a) What do I do now

 

b) Can someone point me to defence, no notice of assignment to CL Finance from HSBC, just a notice printed at the bottom of the CL Finance letter, shortly followed by a court claim form.

Prior to this I had been bullied into paying DG Solicitors as HSBC took my overdraft and debit card away and I was worried they would close my accounts, so I paid £50 p/m until oct 08, when I became to ill to even think.

 

This is the first one I am determined to see through to the end win or lose, I usually give up and let them do what they want, because I just cant cope with it all, but I must be strong, with your help.

Hi, is it a loan, credit card, something else? what date is on the claim form? have you acknowledged service, saying you intend to defend all?

Can you post up, or type the Particulars of Claim, as on the claim form?

Credit card, yes I have acknowleged on-line defending all of their claim and sent off a CPR.31.14 delivered on 13th July to CL Finance as above post, no response so far, what do I do next ? I cant find my original post which shows the particulars of claim, which were very brief and refers to agreement which was not attached. Gotta go out now, but will report back in later. Thanks, please dont go away

I'm back, POC are as follows word for word.

The claimants claim is for the sum of 7*** being monies due from the defendant to the claimant under a regulated credit agreement between the defendant and HSBC Bank PLC UNDER REF NUMBER ..... and assigned to the claimant on 15th December 2008 notice of which has been given to the defendant (yes but on the bottom of a letter from CL)

The defendant has failed to make payment in accordance with the terms of the agreement and a default notice has been served upon the defendant persuant to section 87(1) of the consumer credit act 1974

 

This is from around 2001, for some reason I did not do a cca request as I have done for the other c/cards.

 

I have done the aos on-line and defended it all, Iam happy to pay it at a nominal amount if it comes to it, but would like to give it a shot as I'm fed up with always doing the right thing and these people seem to get away with not doing the right thing, if they cant why should we.

Sorry maddie i don't have time to help you further...count 33 days from the date on the claim form, this is the date you must file your defence by

 

Dont miss it, or you will lose!

Look on the many CL Finance/Cohens threads for a suitable defence

 

For what its worth this is the usual C%ap POC from cohens, so you dont have much to worry about
