hi

 

is my consumer credit agreement enforceable please, i have noticed a line missing on the agreement

"Examples indicating the amount you have to pay appear in the" then a blank line so the text is missing ,does this make the cca unenforceable or are there other terms and conditions missing?

If you upload them to TinyPic - Free Image Hosting, Photo Sharing & Video Hosting & then copy and paste the URL back here we'll be able to see them.

 

On the Tinypic page left click the 'choose' button & a seperate window will open, choose which file you want to upload and left click 'open', the window will close then left click 'upload now' button. What is the procedure to continue to get the agreement un-enforceable ?

 

you cant get it unenforceable

 

it either is already unenforceable or it isnt

 

taken as being the same document (ie front and back of the same document it appears to me that the prescribed terms are "within the four corners"

theres no direct reference from page one to the other that i can see BUT the key terms certainly seem to flow from one page to the other as they do in many agreements

 

personallyt i'd feel that i might be on to a loser with that one and that a judge would rule that one followed on from the other

 

just my gut feeling

Thing is in court they would have to produce the original. If they are relying on copies they have to jump though an awful lot of hoops to get it accepted as anything other than hearsay. Trick is to know what all the hoops are and if they do not have the original and are relying on a copy, hit 'em with them.
