Hi All

 

Well the saga continues with MBNA. In a nutshell..

 

 

10.03.09 CCA request sent by recorded delivery to Lewis Debt Recovery

20.05.09 No response so 2nd letter sent advising them they were in default and again advising non acknowledgement of debt.

Heard nothing until...

13.07.09 Letter received from CL Finance (see below)

and a very dubious copy of an agreement (front page with my details only) dated 23.4.96

 

Now this doesn't show all terms and conditions as requested and equally I have not received a full statement of account - only another summary sheet showing account balance (presumably including all sorts of fees).

 

Advice anyone on what to do next? The way I see this is they are in breach of my original CCA request as did not comply within the legally required time frame - and now have not provided the full agreement and statement as requested anyway?

 

Also last week have received a telephone call from a debt collection agency (AIC) at my work, I was livid to say the least. Explained to the person that the debt was in dispute - suffice to say having had a family bereavement and funeral Thursday this was not appreciated. Also wonder how they obtained my work telephone number?

 

Advice would be much appreciated....Thanks :mad:

Thanks for your advice, where should I be looking for an example of prescribed terms please as I am not sure what they should have sent?

Hi TAO

 

As far as I can see, this doesnt conform, I cant see any prescribed terms, you can send them the account in dispute letter.

 

You can also send the bemused letter to AIC, I dont have a link to it at the moment.
