Parking ticket for been in an urban clearway?

Been parking at the front of my house for 2 years now.. as do most other people on the same block on the road. However this morning I guess everyone had gone to work and mine was the only one left on the road, and I got a parking ticket..

It is a busy road but people manage to pass by absolutely fine, and the only line markings are slight dashed ones and there is even a big gap where I'm parked!

 

The only thing I could see affecting my case is it is an urban clearway... these signs were put up about a year ago but nobody ever paid any attention to them...

So is there any point in trying to appeal?

 

 

Edit: Also there is an observation time of 09:23 to 09:23?

 

Oh and the description on the ticket says: "46 Stopped where prohibited on a red route or clea"

I'm guessing they mean 'clearway'. The time says 9.23am....

The prohibition is absolute, therefore no observation time would be required

There may be a possibility of appeal for the description. I believe the PCN should clearly state the offence and not just rely on a code. As the reason for your PCN being issued is not stated (you are assuming it is for being parked on a clearway but that's not what it says) then it may be invalid. One of the CAG council PCN experts hopefully will pass an opinion on if this is a big enough error for you.

Just down the road.. on the same block though.

 

Shouldn't the lines be in accordance with the signs? There is a gap in the lines, so surely the ticket would be invalid?

Not sure if the yellow line appears to the urban clearweay area, but that yellow line is not legit, it has no terminator

You have already shown a picture to prove this, so if the line is in the applicable area (and what the sign applies to) it's not enforcable :)

An urban clearway doesn't have lines just signs at regular intervals.

G&M is that description of the alleged offence clear enough though? If he is accused of being parked on a "clearway" then shouldn't that be stated unambiguously on the PCN?

Always worth an informal appeal but wouldn't like to gamble a 50% discount on it.
