      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Im going to start my NW reclaim process next week but need a few answers please!

1. I have both a bank account and Mastercard. Do i send the SAR regarding both to this address?

2. A little confused regarding reclaiming charges from the bank account (not Mastercard side). I am aware the OFT case has no barings on the Mastercard (just been refunded of charges plus interest with Barclaycard:)) so will press on there regardless.

My quiery is regarding the bank account changes. On the other bank forums Caggers have gone through the Prelim then LBA stages and have been successful in getting refunds. On this forum it seems that the general advice is that Natwest will put the claim on hold and thats it-nothing more you can do unless you go to Small Claims?

 

Any advice much appreciated

Using Track and Trace it states that the letter was delivered form the Edinburgh PO Collections office 2 days ago but not signed for as yet by Natwest! :eek: Is this normal!!??

Update. Sent SAR regarding A/C and Mastercard last week via recorded. Statements arrived this morning..only had statements back regarding the Current A/C though. Hopefully the Mastercard stuff will arrive shortly... Going to send the Prelim off with table of charges but just noticed a default notice fee. Can i reclaim that too?

Update. A/C Prelim letter giving the standard bog off approach so LBA off soon.

 

Mastercard info back though :) A few questions...

When i recently reclaimed with Bcard they paid up pretty quickly. I was advised not to reclaim interest however as they would just prolong things and that they would put on interest anyway (which they did:):grin::wink:).

Do the same for Natwest?

Also, how are Natwest in terms of paying out on thier CCds. As good as Bcard or will they try and drag things out to court?

 

Any opinions appreciated :p

NatWest/RBS usually pay up after 3 letters on credit card claims ;)

 

Nice :D Prelim off for that soon. :) Do you reckon i should put interest on as per the above post or just leave it? And will they add on interest anyhow ala BCard?

Interesting... Had a reply to the above this morning (at last). Not bad considering I sent my prelim off in the middle of last month and it was signed for on the 21st of August:rolleyes:

Ive got the standard bog off letter as expected offering me around £50. Too bad as ive already sent the LBA off on the 13th of September and theres no chance i'll take that as they owe me nearly £400!:)

 

What is interesting though is that they've offered to put the £50 odd quid into my account. The account is with Intrum Justitia.... Would I be thinking they want to give it to them? If so thats not going to happen!!

What you guys think thier up to?

Another update!

Had another letter this morning upping the amount offered to pretty much the full amount which im happy to accept :).

But to reiterate from the last post,- the account is with the lovely people at Intrum Justitia ;) and NW want to credit my account! Now im guessing that they ethier dont know where my account is or with whom or that they are going to give it to I.J-thats not going to happen!!!!!!!!

What next? I obviously dont want to speak to ethier on the phone but would like a cheque sent to my home address. Is it best to write to them and state that i accept the offer but ask for a cheque to be sent to me? Should i even phone NW??

Im a little confused as to the next step. Cheers! :)
