      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

shAbbey are unbelieveably incompetent!

 

It beggars belief doesn't it and I hope you claim for costs of child care, travel etc in attending court regardless, for the inconvenience they are putting you through!!

why can they not post you a cheque they must have your addreess

 

they could but as this account has been frozen, i only have a savings account at the moment which clears cheques in 10 days. That is too long, i need the money. Luckily my dad has said he will provide the cash if they make cheque payable to him. Should receive it monday or tues latest.

just quick question- they have said that they can only mark the default as settled and not remove it. I argued against this but was told as there was often more money going out than coming in the default cannot be removed. Obviously there was more money going out because of all the charges- am i right in thinking that i can get them to remove it?

Excellent News Sarah - Happy Christmas indeed.

 

The default part - did you include details in your claim POC ? If so it should be negotiated as part of the settlement.

 

If not you may have to go back to court to fight for its removal.

Wow, I've just read through the whole post..... well done Sarah! I just hope my claim doesnt have to go that far! I wonder how long it will be until banks stop paying out (hopefully after I've got my money back!).

christines not getting back to me, and Moorcroft collections are still bugging me- so have sent her this email today

Hi Christine,

Called 2 weeks ago and still not heard back from you with regards to this suposidly settled claim that i am still being chased by Moorcroft Collection agency for.While this is still up in the air, i am not prepared to write to the court to say its been settled as moorcroft say it isnt.

Due to this extra inconvienance i would like the default removed (as on claim form) from my file as soon as possible or i will file N244- and let them know our progress and continue to get the default removed. as we have discussed i believe the default occured due to abbey charges.

Would appreciate a reply as soon as possible but know that you are busy so will hold off filing this form till 1st Feb (1 week from today)

hope we can reach a final agreement on this.

this is unbelievable- moorcroft have passed the debt (which is suposed to be settled) on to midas legal services. I am livid as i told them countless times that abbey have settled with me.

Luckily i waited and didnt cancel the court proceedings, it was adjourned and i now have a date of 23rd April for the hearing which i will attend if they dont get back to me. have called again got voice mail and also sent emails to 3 different abbey email adresses asking them to contact me urgently. what a big waste of everyones time, especially mine

i used the simple excel spreadsheet in the templates and substituted the 8% for 9.9%- hope it helps- if not ask again and i'll try to be more specific
