Account with Next opened around November 2006. Precise circumstances of the account opening are not known to me; I am manic-depressive and opened the account/made purchases when in a phase of mania. I cannot honestly remember whether an agreement was or was not signed; though even when I'm unwell I'm fastidious about keeping proper records. In my mind this suggests one probably wasn't.

 

Request under sections 77-78 of the Consumer Credit Act served on Next by recorded and first class post on 7 June 2008.

 

No reply received, so letter sent to Next on 21 July 2008 stating the balance was unenforceable until they replied, and that I'd stop making repayments.

 

Default recorded on credit file as being effective from 19 September 2008, though no Default Notice was received.

 

Request under rule 31.16 of the Civil Procedure Rules made on 4 February 2009, and reiterated on 10 March 2009. No response received from Next.

 

N244 etc. posted to the County Court today.
