is a manager or any other employer allowed to contact you at home

Hi just need a quesiton asked really,

 

my partners manager takes it upon herself to call her employees while they are off sick bear in mind that person has already called the employer in the morning to tell them that they will not be in that day due to illness.

 

Im pretty sure its not allowed im trying to find some kind of law or rule somewhere about it but have not found anything.

 

The manager is using this as a way to call and try and catch her employees out.

 

is this allowed.

hi terms and conditions state you must report your Absence on your first day of absence.

so once you have done this in the morning, you should have the right not to be contacted am i right?

If they are self certifying then I can't see it as being a problem, however, if they are signed off sick then I would have thought that the answer is no unless it is towards the end of the date that the person is signed off by a doctor.

it is expected with my employers that my or another mamanger will contact us to keep the lines of communcation open and incase we need anything .

 

ir's all about being a caring employer.

 

i can't see how them phoning is too catch people out? do you mean actualy not in the house?

There's no reason your employer can't contact you. It's perfectly reasonable that they may want to find out a likely return date and/or see if there's anything that can be done that would aid a quicker return date. Even with long term sick they may contact you to see what the situation is and whether you will return once the sick note expires...in fact they have a duty of care to do this. However, if they are contacting your partner on a daily basis then that could be seen as harrassment.

I leave my answering machine permantly on,any caller can state their business I never acknowledge any call that I don't want too.

If you are off sick it doe's not mean you are housebound, so you do not have to be at home 24/7 to take calls
