So we approached Cap One for charges refund and contractual interest.

All approaches have been met by the party line ("not us guv! we've done nuffink wrong") even after I've pointed out that the original £84 plus £28.48 interest will increase by £30 court fees and £66.30 for other costs.

I guess I shouldn't be surprised or annoyed but after gleaning considerably greater sums from AA,B Card, Citi, HX, Natwest and RBS (and yes I have chipped in my 5% to the cause) without any significant resistance, and knowing that they will NOT defend their 'fees' in court I am b****y annoyed about having to submit N1 (copied to them with the usual nondescript reply) and possibly AQs for such a relatively small sum.

Isn't there some way of putting them on the spot about wasting the court's time - cos you know they'll backoff and I know they'll backoff?

Short answer 'NO'

 

They will only pay up after Court Papers received, never before.

Nearly everytime they pay up before court. You may get offered the purchase rate of interest instead of the contractual though.

IF they file a defence, does anyone think it probable that a move to have the defence thrown out (on the basis that they never have defended such a claim and are extremely unlikely to do so) would meet with success?

I know my digestive tracts would feel better.

Kenny, I very much doubt they will, they paid me as soon as they recieved my court papers, keep us posted.

MD - Aviator,

letter received today covering EVERYTHING asked for including court fee £30 and 'Costs & disbursements' £66.30! Goodwill gesture - yahdy,yahdy, yahdy.... cheque in 21 days and they've written to court that they've paid in full.

Very many thanks - I shall be giving my (or my daughter's) 5%.
