    • Thanks for posting the CPR contents. i do wish you hadn't blanked out the dates and times since at times they can be relevant . Can you please repost including times and dates. They say that they sent a copy of  the original  PCN that they sent to the Hirer  along with your hire agreement documents. Did you receive them and if so can you please upload the original PCN without erasing dates and times. If they did include  all the paperwork they said, then that PCN is pretty near compliant except for their error with the discount time. In the Act it isn't actually specified but to offer a discount for 14 days from the OFFENCE is a joke. the offence occurred probably a couple of months prior to you receiving your Notice to Hirer.  Also the words in parentheses n the Act have been missed off. Section 14 [5][c] (c)warn the hirer that if, after the period of 21 days beginning with the day after that on which the notice to hirer is given, the amount of unpaid parking charges referred to in the notice to keeper under paragraph 8(2)(f) or 9(2)(f) (as the case may be) has not been paid in full, the creditor will (if any applicable requirements are met) have the right to recover from the hirer so much of that amount as remains unpaid; Though it states "if any applicable ...." as opposed to "if all applicable......" in Section 8 or 9. Maybe the Site could explain what the difference between the two terms mean if there is a difference. Also on your claim form they keeper referring to you as the driver or the keeper.  You are the Hirer and only the Hirer is responsible for the charge EVEN IF THEY WEREN'T THE DRIVER. So they cannot pursue the driver and nowhere in the Hirer section of the Act is the hirer ever named as the keeper so NPC are pursuing the wrong person.

    • Good afternoon, I am writing because I am very frustrated. I received a parking fine from MET Parking Services Ltd , ( Southgate park Stansted CM24 1PY) . We stopped for a quick meal in Mcdonalds and were there fir around 30 mins. We always do this after flights and never received a parking fine before.  Reason: The vehicle left in Southgate car park without payment made for parking and the occupants southgate premises. they took some pictures of us leaving the car. i did not try and appeal it yet as I came across many forums that this is a scam and I should leave it. But I keep getting threatening letters.  Incident happened : 23/10/2023 I did contact Mcdonalds and they said this:  Joylyn (McDonald’s Customer Services) 5 Apr 2024, 12:05 BST Dear Laura, Thank you for contacting McDonald’s Customer Services. I’m sorry to hear that you have received a Parking Charge Notice following your visit to our Stansted restaurant.   We've introduced parking restrictions at some of our restaurants to make sure there are always parking spaces available for customers.   We appreciate that some visits such as birthday parties or large group visits might take longer and the parking restrictions aren't intended to stop this. If you think your stay will exceed the stated maximum parking time then please speak to a manager in advance.   Your number plate is scanned by our Automatic Number Plate Recognition (ANPR) system when you enter our car park, and then again when you leave. If you have overstayed the maximum time allowed, you will not be notified straight away- a Parking Charge Notice will be sent to you via the post.   If you feel that a Parking Charge Notice has been issued in error, please contact our approved contractors who issued the charge in order to appeal the charge. Unfortunately McDonald's are unable to revoke parking tickets- the outcome of the appeal is final and cannot be overturned by McDonald’s.   Many thanks for taking the time to contact McDonald’s Customer Services.   Can someone please help me out and suggest what I should do next?  Thank you

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I got a loan 2 years ago, and due to ill health had to give up work, the PPI was rejected as I wasnt entitled to incapacity benefit due to not enough contributions.

 

I manage to renegotiate my repayment and got them reduce to a third of the amount. Unfortunately 8 weeks ago I took seriously ill again, and I have no income coming in apart from ESA. Ive explained this to my local branch, but they are demanding proof I have no other income and want 6 months bank statements from me and my award letter.

 

They are now calling 4-5 times a day, and every phone call is running up to a £25.00 charge. Ive written to them, asking for any correspondance to be in writing, but they are still calling me.

 

Last one was 2 hours ago, as Im sat in the doctors office waiting to see a specialist after recieving bad news about my health this morning!!!

 

What can I do next.

Hi all, Im new to this site today and wondered if anyone could help me.

 

I have a small unsecured loan with WF, and 3 months after I took it out I had to make a claim in the insurance, but that was declined as I wasnt getiing Incapacity benefit, but only carer's allownace.( I hadnt filled in the correct bit, and by this time I was in arrears)

 

I renegotiated with local branch here in Aberdeen, and was managing fine until 8 weeks ago when I had to give up my wee part-time job due to severe ill health. But even before this when I let the branch know that I had a job and wanted to change my DD date, they were calling me up at work 3-4 times a day, just after the payment was due, and I gave it to them over the fone.

 

I wrote to them and asked them to stop calling me at work and durign office hours, as this could lead to me losing my job, whcih wouldnt do them any good!!!

 

Anyways back to 8 weeks ago, I let them know what was happening, and I managed to make 1 months payment, but this month Im struggling even to pay the gas & electric etc.

 

So far this month Ive had 11 calls from them, and each call racks up a £25.00 charge, even though I asked them no put all correspndance in writing. The last one being today, when I was sitting wating to see a specialist in the hospital after some bad news, and I think I swore quite badly at the lassie!!!! OOOOOPS

 

Tehy are now asking for proof of income, ie benefits etc and 6 months bank statements from me!!

 

I have a meeting with the money advisroy in the Tradign standard dept of the council next week, but just wondered how can I stop them calling me all the time.

 

The stress is making my illness worse.

well you really need to do some reading in this forum.

you are not alone.

now there are other things afoot with welcome that could see everyones trouble evaporate according to the chatter in this business wires at present.

 

anyhow.

 

right these charges, reclaim them, they are unlawful & against OFT guidelines.

 

as for the telephone harrasssment

there is a template letter for that just see the homepage or the temple/library section.

 

one final point:

NO creditor has any LEGAL RIGHT to know ANY of you financial goings-on.

don't tell or give them anything, well tell them to b*gger off if you like

and stay off that phone!

just refuse to answer their security questions.

 

do some reading ....really.

the more the read the stronger you become

It would seem that the payment protection wasn't worth the paper it was written on....a dispute letter to reclaim the PPI stating that you are of the opinion that the so called insurance was useless and that you want this repaid + interest.....

If you have previously had PPI with Welcome then make a claim for that also....

 

As for the harrassment...send this by recorded delivery along with your dispute letter -

The rejection came from on the guys in the local office on the phone. When i re-negotiated i dont think there is PPI on it at all, I will need to look at the agreement again.

 

I know Im owe them money and have asked them for some leeway just now while I get my health sorted out.

 

I just wish they would stop calling me, 3 calls this morning so far that I havent answered. 1st one was at 8.25am!!!!!

 

Ive got to see the money advice people at trading standards next week, and they said they were going to look through all the paperwork Ive gotten from them.

 

Ive printed off the letter about harrasement, and will get that away by recorded delivery today.

all claims ref ppi and welcome are delt with by direct group

Could I even claim for the PPI even if it is over a year since I renegotiated?

 

Also spoken today to Trading Standards and the branch up here is being investigated by them for harrassment and bullying!!! the guy would give me any details, but just added Im in a long line of complaints against them that they were looking at.

They have said I had a policy that was 'partially refunded' and never had a claim against it!!!

 

They cant send out a copy to me as it was partially refunded.

 

This is news to me, as I was told it was cancelled by Welcome when I had some arrears, that led to the renegotiation.

Its just occurred to me as well after reading another post, that when I got the payments reduce, and I think they took out another loan to cover etc, that the rep in the local branch asked for my husbands wages, even though the loan was completely and solely in my name.

Don't let the branch bully you, claim everything back from them that is claimable, Welcome are on very dodgy ground and have a huge 'financial black hole' in their 'creative accounts'.

 

I was told by a little bird that the staff at Welcome had their salaries reduced to the minimum wage level and their commission increased... don't know how reliable that info is though, the local branch here seems to just be a 'postal address' and is visited once every couple of days.

Just had a letter from tham saying that since the last DD didnt go through as I cancelled if after telling them I was struggling, they have added £25.00 onto my account that needs to be paid immediately.

 

3 more phone calls today from them as well. I have a note of all the calls, as my mobile lists them along with dates and times.

Urgent help please,

 

2 welcome reps just been to my door, I said I wasnt allowed to talk to them, and closed the door on them. I locked the doors and they kept banging for 10 minutes.

 

Im totally shaking here, Im in the house with my children as hubby is at work.

 

theyve left another letter marked urgent and no doubt will add a load of charges onto my account.

 

They should have had the letters about putting everything in writing as they were posted 1st class recoded on Thursday.

 

What do I do now.

sent them the no doorstep visitors letter from the DCA templates section

they have NO LEGAL POWERS

and should not no longer worry you like this after the above letter

 

just tell them to go away or you wil call the police.

they have NO RIGHT OF ENTRY in ANY way shape or form.

 

as for the charges

add them to you list and claim them back.

According to the letter, I have arrears of £315.06, and I know I only missed 1 month payment(1st July) of £105.02. So according to WF, Ive amassed charges of £210.04 in 20 days. £10.50 a day!!!!!

 

The more I think about it the angrier Im getting actually.

 

I went to them in the beginning when my health started deteriorating and explained the situation, but now they are just committing daylight robbery and stressing me! They are no more helping me than a chocolate fireguard would help.
