    • I thank the Consumer Action Group Members for getting me this far in my case which is still in progress.   Situation: The Court has reversed earlier permission for me to rely on witness summaries.    The question upon which I am seeking help, please,  is - do I need to bother myself as to why the Court has reversed permission to rely on witness summaries?  If so, what line of logic or law can might I follow because clearly, the Court has said one thing and then another a few weeks later, of its own motion, the Court has reversed the earlier decision. I find this development quite extraordinary in the sense that as a result of being granted permission earlier, I served the three Witness Summons which had the Court stamp.   Background Having given me permission to serve 'Witness Summons' which I served on 3 hostile witnesses several weeks ago, the Court has now reversed it's earlier decision, and refused me permission to rely on 'witness summaries' pursuant to paragraph 32.9(2), citing that I have not shown steps taken to obtain witness statements from the 3 hostile witnesses.  I however, made two attempts to talk to the hostile witnesses who have been non responsive and I can evidence this.   I would be immensely grateful for some steer from Forum Members, please.

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

You have probably heard of this problem many times before. Well, I sold an Iphone 3g to a UK ebay buyer for 300GBP. The payment had not cleared in my PayPal and I was to go on holiday the next day. So I gave my brother the parcel to send as soon as the PayPal payment had cleared. I told him to send it "recorded" and he told the man at the Post office to send it recorded. I told the buyer that item was shipped on a Saturday, yet he emailed me both Monday, Tuesday and Wednesday claiming he had not received it. He filed a PayPal dispute, first as "Not as described" and then he changed it to "non-receipt". I asked my brother for the receipt from the Post office and I saw that it had not been sent as recorded but instead "first class" although he specifically asked to send via recorded mail. Now, I am in a bit of a trouble since PayPal has refunded the buyer for the Iphone in full and I have a negative debt in my PayPal account, luckily no funds have been taken yet. I messaged the seller through ebay and he was very immature and could not spell a single word correctly, I felt as if I was dealing with a 12 year old. I am personally certain that he has received the Iphone but just saw an opportunity to claim it as not being received just to get a freebie. I also did not get any parcel returned to me in the mail (the package had my return address on it). I did provide paypal the postal receipt but that was "insufficient" information for them. I have now sent Royal Mail a lost, damaged or delayed claims form and I am waiting for the outcome of the investigation. I have no reputation on ebay for not sending item as described or non-receipt and I am not willing to refund the buyer or PayPal either. PayPal as usual has made the least effort in their responses and just dont care other than just taking the money. Could anybody please advise me on this matter and what I can do? What will happen if I decide to close my PayPal account, can they still take the money from me? Thanks

You are in the wrong - totally and utterly. Even if your brother sent it 'Recorded' this would not be enough - it had to go 'Registered'. First Class and Recorded will provide compensation up to around £34. If sent my Registered, the FULL value of your eBay listing would have been repaid.

 

As it is, you'll get the £35 or so and that's it.

 

As for PayPal - well, since the buyer also has rights, and you didn;t take any steps to ensure there was tracking or a signature on delivery (a PayPal requirement to protect everyone), what you are suggesting is to defraud PayPal because you or your brother fouled up. Why should PayPal 'buy' a phone they don't have?

 

I would imagine yhey have locked your account to prevent you cashing out the credit - this will be returned to the buyer's account, and the shortfall will then be debited to your account and they'll instruct debt collectors to pursue you.

 

If you've already removed the funds, they'll come at your for the full amount. Bottom line, they've done nothing wrong, and neither has your buyer - the buck, sadly, stops with you for not taking care of your property whilst it was shipped.

You always amaze me with your answers TLD!! Just wish my brain worked in the same way!! :p

 

 

Geo, my little mate, you've been scammed. Whilst I thought Buzby could have been a little more sensitive in his approach, regrettably, he is right...the item should have been sent registered post.

 

Nonetheless, even this isn't 100% as it's not uncommon for buyers to claim that the item was not as described and perhaps return to you a parcel full of sand and stones or the likes!!

 

PayPal will instruct debt collectors but I have not yet heard of anyone who has been taken to court by them, probably because they act as Judge, Jury and Executioner in resolving disputes.

 

I pray you have a record of the IMEI number as that will wipe the smile off the little runt's face.

 

Best of luck and, if you do have access to your PP account, delete all financial details and also cancel any PP direct debits immediately with your bank.

Thanks guys. I do realize that I might be at fault here too, and to be honest if anything it was a careless mistake. However, I have a good feeling the item was received as there was a return address on the parcel and nothing had been returned to me. Furthermore, I checked the electoral register and there is nobody registered by the name of the buyer at the address that was given to me. I do have the IMEI number and have told the buyer that I will block the phone within 48HRS should he decide to be honest about the situation. I am thinking of just closing my PayPal account (which is registered in Germany originally, and I am not a registered resident in Germany anymore either). I do not want to be a crimincal but 300GBP is a lot of mullah for a student to be giving for free. What would happen if I just close the account and remain silent?

 

p.s. Never using PayPal again, I did not know the buyer protection insurance actually meant that they take the money again out of the sellers pockets. I am an honest seller and never had such an incident before, real shame.

What you need to do Geo is cancel any PP direct debits with your bank asap.

 

Depending on the type of PP account you have, you may also have registered a credit/debit card with them. I would delete all these details from your PP account without delay.

 

So glad you have the IMEI number...that has really made my day!!!:D

Thank WelshMam, thanks to Itunes I have been able to find it out. Yes I have just contacted my bank to block any debits from PP. I will also report my credit card as stolen and just get a new one within a few days. Thats the easiest thing as I cant seem to be able to remove the CC from PayPal due to the limited account (a$$holes). Now, if I do all that and keep quiet will they hunt me down. I am not officially registered in Germany anymore (where my PayPal was registered) however, the registered address is the home of my parents which other tenant live in now. The phone number provided to PayPal also does not exist anymore. Is there a chance the new tenants will be getting nasty mails in their post box from debt collectors?

Any letters will be addressed to yourself so your tenants should not open. Suggest you simply return them with "not known at this address" on to begin with.

 

As I said, Debt Collectors can be dealt with quite simply with a cease and desist letter. I have read loads of threads on here and other forums relating to eBay (I am a seller) and have not heard of PayPal instigating court proceedings for such disputes.

 

However, you may find that your eBay account is suspended as PayPal are owned by them.

 

Don't worry about it, you never know, the item might just miraculously arrive now you have threatened to block the IMEI number!! :rolleyes:

Ill just open another ebay account then as a UK registered user, just to buy stuff. However, I doubt ill want to deal with them again. I have asked my bank to block any debits from PP and will change my credit card just incase. Thanks all for the advice.

Forgive me for continuing to be blunt, but from your response I gather that your solution to the problem is to shove the blame onto PayPal, and you'll (effectively) steal from them by skipping on the debt?

 

It's not right, and it's not cricket. What started out as a 'PayPal is unfair' thread, turns out to be 'I screwed PayPal'.

Seems so, I think many people would be glad if " I screwed PayPal", not saying that it is right. The point is, the item was shipped, never returned to me, there is a possibility it was lost or stolen, who knows. Hope I find a solution asap. I just think that many people who were in my position are unhappy with the way PayPal has treated them, even in cases were the item was shipped tracked or returned in a worser condition. Listening to those comments, just makes me want to screw PayPal over for their sake. Again, not saying it is neccesarily correct but they have screwed many more of their customers.

Paypal seem to screw everyone else, people like me and andy who are trying to get our money that in a way could be classed as 'theft'! If anyone screwed Paypal over i wouldn't give a toss about Paypal and wouldn't feel sorry for them at all.

 

I've read hundreds and hundreds of stories like mine where people have never got their money back even after 180 days now that is theft so if they can screw people over and take people's money then why not play them at their own game?

I think it's more a case of the buyer screwing the seller Buzby.

 

As I said earlier, registered post does not entirely solve this problem as unscrupulous buyers simply issue an "item not as described" dispute.

I got ripped off like that too-the item was never returned and PP sided with her-she probably laughed all the way to the bank. PP didn't keep chasing me for the negative balance-I just paid it when I had it. You can't close your PP account while you have a negative balance though...

I'd love to get rid of them altogether...another service I recently found was AuctionChex-much more helpful.

Not quite the same issue! You don;t say why the buyer won their dispute, but it not the case that PayPal rules in their favour and they don;t need to return the goods. They do - and they must send it back tracked.
