    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share. 
    • To re-iterate and highlight my urgent question on this one: The N24 from the court did not include any instructions to submit paperwork 28 days before the date, unlike the N157 received for other smaller claims. Do I have to submit a WS for this court date? Link has!...
    • No, reading the guidance online it says to wait for a letter from the court. Should I wait or submit the directions? BTW, I assume that the directions are a longer version of the particular of claim accompanied by evidence, correct?
    • Thanks for opening, it's been another rough year for my family and I've procastinated a little.. Due to the age of my defaults on this and other accounts (circa 2021), I really need to avoid a CCJ as that will be another 6 years of credit issues. Mediation failed as I played the 'not enough info to make a decision' however during the call for some reason they did offer settlement at 80%, I refused. this has been allocated to small claims track, court date is June 3 and I've received their WS. I'm starting on my WS. They do appear to have provided everything required of them (even if docs could be reconstructions). Not really sure what my argument is anymore but I do want to attend court and see this through. Should a judgement be made against me then I will clear the balance within 30 days and have the CCJ removed - this is still possible isn't it? I'm going to be reading up today and tomorrow and hope you can provide me some guidance in the meantime. Wonder what your advice would be given the documents they have provided? I am now in a position to clear the debt either by lump sum or a few large installments - Is this something i should look into at this late stage? Thanks as always in advance
    • I have now received my SAR. It includes a great deal of information! Is there a time limit on how long account information is kept and/or can be provided to debtors? I have received many account statements which were not previously sent to me. I remember that the creditor should provide explanations of any acronyms and abbreviations that maybe used in the documents. Is this still the case? Also what, if any, are the regulations in regard to adding fees to a debt? Can fees be added to a debt after the court has approved a charge on a property. Perhaps due to the numerous owners of the debt, many payments I made were not properly recorded on the account, some were entered over a year after the payment was made! Following the Legal Charge, I paid every month until my payments were refused. I am trying to compute the over payments, but the addition of fees etc. is confusing me. Any comments and/or help would be appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys,

 

Looking for a little advice.

 

I am in the process of applying for a DRO with CCCS. I have my telephone interview tomorrow. I would like to know what to expect to be asked as I am slightly nervous, I don't know why but interviews make me nervous.

 

I have wrote down all the details they asked me to prepare and got my budget ready, I think I have been very tight as I have only allowed £20 a month for sundries (Birthdays/Christmas), thats £240 for a large family and my daughter!

 

Also, Does anyone know what happens after the interview, will my application be then granted/or will I need to wait for confirmation. I have no assetts, no car (my dad is the legal owner, I borrow it from him), and my income allows me £30 a month left after expenses, and I have debts of less then £15,000.

 

Please help anyone. Appointment is 10:00 tomorrow, if no-one knows, I will post so future CAGGERS will know.

Wish I could tell you guys, My contact was away so someone else took over my file, she was useless. She wanted to know all my debts again and I was'nt prepared for that and needed my account numbers (I did'nt have that on my list of things to get ready) so I had to re-scheduel it for the 29th July. Please could you let me know how you get on.

 

I was all prepared with everything, I was so angry and I got creditors getting more and more angry and threatening door stop visits which I've sent a basic template letter saying you cant under english common law. I just want to tell them, I am on a debt relief order now f*** off.

Yeah same here, If it is any consilation I had to attend court having being order by one one of my debtors last month which made me take action and find this forum funny enough, When I attended court I had to give a breadown of my income and expenditure and it was the court person at the end who stated to me that as I do not own my home I have no real assets there is not alot a debtor can do, If you really have not got the money you have not got it.

 

As for doorstop collectors pay no attention to that, The only way that can happen is if a CCJ is applied and you fail to keep up the payments issued by a court, It's just scare tatics sleep easy.

Excatly, can't take what I've not got. No assets and my dad legally owns my car. Just want the 29th to come along as I can say to anyone who rings, I am on a debt relief order now go away. My income won't improve, my job's not going to get better paid, no chance. I am just going to have to over prepare for CCCS next time.

Hi guys,

 

Finally sorted my DRO.

 

I spoke to CCCS yesterday. Please PLEASE please allow more then 45 minutes as stated on their letter. I took 60 minutes yesterday and another 45 minutes today, aswell as 30 minutes last time so when you take time off work/planning your day, allow 2 and a half hours!

 

In the interview, the lady never went through the checklist, only my employers details and my budget and income.

 

The main things to have ready are. Your debt details/how much you owe at present (say you owe £200 to cap1, and only say £180 for your DRO, you are still liable to pay £20 plus), your account numbers and addresses for the companies if possible. This is what caused the longest delay, even if CCCS have previous details, have them ready!

 

I had my budget set out ready so this was quick.

 

so in summary:

Budget Details,Account Details,Income details,Employer Details.

 

Make sure you've sent everything to CCCS such as proof of income and make sure you pay the fee of £90 before the interview. I got in trouble for not paying it before today.

 

The application has now been submitted, they are sending me a copy which I will have to sign and send on to someone. I assume I can now tell creditors I am subject to a DRO. Its now up to the insolvency service to accept this which I hope they do.

 

Also, I got in trouble as I had paid off £4 to Empire Direct and no one else so there is a slim chance it might be revoked/rejected.

 

If anyone needs any more info or advice on the budget, let me know.

My DRO paperwork came through the post 2 days ago. All approved. The monentry period ends on the 4th August 2010. Now under strict conditions. Each time I get a letter, I just email them and say I am on a debt relief order, Barclays sent acknoledgement also.

 

Anyone have any idea how I can get a new bank account with basic things and no credit as I can't get one with RBS due to my DRO. I see Co-op do one and Barclays do but I have accounts with them for my DRO, every other bank does a credit check and rejects due to the DRO.

I read your posts and wondered how you got on?

 

Can you advise me on the following....

 

I am currently waiting on a call back from the CCCS regarding apply for a DRO. It is not until 3rd September.

 

Do you know if I will have to close my exsisting bank account?

 

It has no debt. The debt I have is from an old over draft, a old loan and an old credit card.

 

Will my exsisting bank be contacted by any one letting them know I have a DRO in place if I do go that route?

 

I have a credit card that has debt on it but it is being paid off by my sister (she has a reg payment set up)

 

Will any creditors other than the ones I put on my order be contacted?

 

Will my land lady be contacted?

 

I read on one site that while in your one year order you have to alert any other creditors if you borrow more than 500 pounds. So you can have credit as long as you are paying it off.

 

Seems strange you can have credit still is this right?

 

Does an appointed person have to visit where you live?

 

Any advice would really help me out.

Hi there, lots of questions but I can help. I am still with my exsisting bank, I have'nt told them about my DRO because as far as I am concered, they do not need to know espically if you have no debt with them. You can choose which debts to include/not include however it is advisable to include all debts and make sure you have up to date balances. I am going to assume you do not want your family to know about your DRO like myself so you do not want to raise the subject with your sister. Yes that is correct, you can still borrow up to £500 whilst on a DRO, This is £500 in total, not £500 per a creditor, for example if you had a credit card with a limit of £300, and the bank offered you a overdraft of £300, you would have to inform them of your DRO.

 

The landlady/lord has not been told unless you have arrears with them to be written off, the only way they would know is if they did a credit check on you but to be fair, if your paying your rent OK, they won't mind.

 

No-one had to come and visit me, the office for DRO's is based in Pymouth, it is not court based. They may need to ring you to discuss any issues however they are very busy and do not have much time. I got my DRO through the post within 2 days of my interview with CCCS.

 

I assume you have a interview with CCCS on the 3rd Sept, good luck. Make sure you have the following, a list of all income and make sure you have sent in your proof of income i.e wage slips,tax credits , also make sure they have a list of your debts, your account numbers and addresses for the companies, keep a copy yourself and get a up to date balance before your interview, also have your monthly budget and be generous for things such as food and clothes, I was left with a minus figure a month!
