    • Ok thanks guys for all the help & advice I think I will go the DRO option but will open a new bank account somewhere else first etc.  The only other things im little worried about is reading on the DRO it says about I wont be able to apply for credit but what about things like my car insurance as thats classed as credit paying it monthly Plus they say i must not have assets or car worth over £1,000 so what about things like my car worth around 2.5k and as said before when my father passed away he left me his camper that I cant part with its worth about 4k and what about things in house and jewellery etc ?? Can they come to house and check and so on

    • read it proprly.. it doesn't say WILL anything and original creditors don't do court as they don't want the judge delving into their business model nor the bad publicity.   as for the FOS you just have to let it run. yours is a very short time since yo put it into them typically it always takes 6-9mts normally before they move on anything though they usually send you an ACK they have the complaint.        
    • Since the last post on this thread I have sent a complaint to the FOS but have not heard anything from them as yet either, I'm guessing they're rather snowed under and on reduced staff so no real surprise.   Still had nothing approaching help from lending stream but today they emailed me default notices for the loans, again demanding I phone them and pay up in full or they will begin court proceedings.   Any advice as to how I should proceed please?
    • Hi,   I received two PCNs in October 2019 from Havering Council. All the below applies to both PCNs, as the correspondences were at the same time:   Fast forward to February 2020, I file witness statements on grounds that I made representations within 28 days but did not receive a rejection notice.   The TEC cancelled charges.   Havering write to me asking for supporting evidence of representations that I made.   I email them screenshots with timestamps of the representations.   In early March Havering reply to me by email 'confirming receipt of email and both cases are now on hold pending an investigation. Please allow time for a full response to be sent.'   Fast forward to 18th June Havering write to me the attached:  Havering Charge Certificate.pdf   Now, it seems as though the sender of this letter is not up to date with both cases and is unaware of the TEC's decisions, as well as the email correspondence.   My questions are, 1) What should I do next? and 2) Is there a way to use their misstep to avoid paying for the PCN entirely?   Thank you.

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Barclays mistake, i get charged =)

Little problem compared to most on here.

 

I asked barcalys for a new card as i lost the old one. Its a student card, thus, easy to identify on their system.

 

I didnt know my card or account number, so requested a new card and pin for my "student account".

 

All went find, got my card, my pin, used it one day, THEN

 

You have used your reserve and have gone over?

 

Huh, what had happened was, barcalys had sent me the wrong card out and i didnt even check as i just guessed it would be right.

 

I rang barclays and asked for this £22 to be excused as it was a mistake on both parts, maybe a little more theirs. But the person on the phone just couldnt understand, and in the end they hung up???

 

I was thinking going into the branch would be better, but its a fair few miles away and impossible to part without a fine in its-self (parking in car parks).

 

So, do you think i will have any luck or is it best to put it down to one of those things?

 

Whilst on the subject or reserve, i have been 1 or 2 pounds over before and got slammed with £22, and then no realised and racked up as much as £110 in charges one month as all for a few quid, is there any cause for complaint in that?

Hi,

I'm reading between the lines a bit here. It appears that you don't keep all your paperwork from barclays.

 

If that is the case, SAR them then claim back the charges.

 

It costs £10

Send the SAR by recorded delivery

Give them 40 days to reply.

Hi SF,

 

I doubt going in to the branch will get this resolved - they'll say they cannot refund because blah, blah, blah !!

 

Use a SAR if you don't have all details of charges suffered. Put the charges onto a site spreadsheet and send off to Barclays with a Prelim Claim letter.

I disagree re going into the branch it is much more difficult for them to refuse you a refund when seeing you face to face. They have made an error sending you the wrong card so should refund you the charges. If they are not helpful tell them you will complain to FOS where they are automatically charged £450 for the complaint so by refusing they are actually automatically costing themselves money!

The problem is that local staff have virtually no discretion in such matters, or will say they have none to avoid refunding.

 

Looking back at your first post, you should make a complaint to customer services about the wrong card being sent out and used. Even if they won't refund, they should at least help you get the right card issued.

The twenty two pounds is a charge they apply for EVERY FIVE DAYS you go into your RESERVE they have changed your account to an ADDITIONS ACTIVE ACCOUNT I also had one as I earn over a certain amount of money and ended up paying over £400 of charges in 3 months GO TO YOUR BRANCH NOW as they will rinse you like this until you tell them to stop I had to change my account to a current account just to stop it

Hi.

 

I have got rid of this £150 silly overdraft product, even though they spent time trying to convince me that its a good service and i should keep it as it comes in handy.

 

Not got the other charges removed, they said its my own fault for not checking the account number on the card when i received it.

If it was in writing, report the matter to the FOS and ask them to help get the charges refunded.

 

This was the bank's error from what I see.

So Barclays can make as many mistakes as they like but then it is your fault for not checking up on them! As above, report it to FOS, as an aside did you even know the new account number to be able to check it was correct. Good luck.

I would totally agree with what slick has said and I would ask for a final response from Barclays. The bottom line is that a card was issued from the wrong account and you did what any reasonable person would do, which is to use the card. The fact that you coulda, shoulda etc,etc, is irrelevant since when you did finally realise this you made every effort to correct it and make sure that Barclays ordered you a card on the correct account. Inconvenience on your part and an error on their part.

YB makes a good point here. SF, can you confirm if there have been letters exchanged between you and the bank.

 

And did the bank's last letter say, "You may consider this to be out Final Response in the matter." or similar.

 

If not, ask them to reconsider and , if they won't correct their errors, ask them to confirm this is their Final Response so you can refer the matter to the FOS.

Letter only states the fees, the branch told me it was my fault and they removed my excess overdraft reserve thing.

 

I have sent the SAR as advised, i think i have done everything that has been advised so far too.

 

My next move is to send them a letter stating the facts of the wrong card was issued, and i used this card thinking it was to my main account.

 

I had well over the sum i took out the cash-point in my main account, so this should show i had the funds and a simple mistake was made and thus £22 is a little OTT for a few days mistake.

Ask them for a final response so that you can take your case to the FOS. My personal opinion is that the FOS will agree with you because any reasonable person would have thought that if they lose their student card that their student card would be replaced.
