    • Okay please go through the disclosure very carefully. I suggest that you use the technique broadly in line with the advice we give on preparing your court bundle. You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above
    • In anticipation of lodging my court claim next Weds 1 May (14 days after advising P2G that was my deadline for them to settle my claim) I have completed my first draft POC as below: Claim Claim number: xxxxx Reference: P2G MAY 2024   Claimant xxxxx   Defendant Parcel2Go 1A Parklands Lostock Bolton BL6 4SD  Particulars of Claim The defendant has failed to arrange for the safe delivery of the claimant's parcel containing a 8 secondhand golf clubs (valued at £265) that was sent to a UK address using their delivery service (P2G Reference xxxxx). The defendant contracted Evri to deliver the parcel (Evri Reference xxxxx) and refuses to reimburse the claimant on the grounds that the claimant did not purchase their secondary insurance contract. The defendant seeks to exclude their liability in breach of section 57 Consumer Rights Act. The secondary insurance contract is in breach of section 72. The claimant seeks reimbursement of £265, plus P2G fees of £9.10, plus postage costs for two first class letters to P2G of £2.70, plus court fees, plus interest. The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from xxxxx to xxxxxx on £276.80 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £xxxx   Details of claim Amount claimed £276.80 I look forward to your thoughts and comments guys! As ever, many thanks - G59
    • Hmm, that's strange how they got my email then.  I assume the below is ok to send to DCBL, Nicky?  Hello, I am writing regarding our ongoing dispute and the upcoming court claim reference xxxxxxxx. To ensure fairness and transparency in our communications leading up to the court hearing, I request that you use postal mail exclusively for all further correspondence related to this claim. Please refrain from sending any communication or documents via email. Thank you for your understanding and cooperation. If you have any questions or need clarification, please feel free to contact me via postal mail at the address provided above. Yours sincerely, xxxx
    • In the SAR, I received the original application, lots of computer print outs, yearly statements from 2013 and the new emails regarding my complaint. They sent me a £50 cheque after I chased them for the SAR after the 30 days. They said they was waiting for me to respond to an email (which I never received) before sending the SAR

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Brief outline on this one.

I bought a car on finance from welcome finance back in 2002,i had it for about a year and then i was struggling with the payments, they were £160 a month,i rang my local office and i went in and they said they could lower the payments fo me,they done this by doing the loan again, they dropped them to £92 a month, they said they would add the remainder of the other loan i had to the new one, which was about £2000,i went away happy. After 5 years i finished paying for it in 2006.again i was happy.

This year i recieved a letter saying i still had an outstanding balance of £2000 with them,i in my stupidity ignored it,thinking i had paid it all off.In june i got a letter to say i had been given a county court judgment from northampton court, and i also now have an attatchment of earnings taking £20 a week.I visited my local welcome finance office, and the guy i spoke to said "it was from 2002"now this was when i dropped the payments.i thought they had added it to the other loan, and as i had paid that one off,i thought i was finished but according to them i havent and i need to pay them the £2000 or so to.

Is this right??does this mean they kept the other loan open??

I am at a loss, not sure what to do.

How do i go about sending a subject access request? There is a template letter in the forum, I will try and find it for you. You basically send the letter with a £10 postal order and request all the information they hold on you under the Data Protection Act.and what is a CA request?? A CA Request is a Credit agreement request which is when you ask for a copy of your Credit agreement(s)what did u mean that welcome are having problems??financial trouble,is this why they are chasing me for this It would appear that they are goting 'bust' but I am not completely up on the subject, Others on the forum may be.

I hope this has helped. I'll find the Templates and post them for you.

this one for SAR,should contain your cca,no need to request separate,

would send to compliance,

SAM

Thanks for finding that Sam I couldn't remember where it was.

I agree that they should send CA in SAR but I didn't know if it was worth a CA request as it's a shorter time limit to produce.

Good luck smiffer, and it might be worth looking in the Welcome Finance forum to see the state of play with regards to their possible demise.

I would advocate requesting your sec 77/78 request seperately and recorded delivery enclosing a £1.00 PO and print your name no signiture. This places the Claimant under time restiction of 12+2 and places them in default of your request quicker than the S.A.R which they will probally ignore.

i think a cca would be no good on this one as a ccj has been granted.

welcomes response would be that they are under no obligation to provide one now the account has been terminated by a ccj

an sar is a different matter

they have to, by law, respond

Ok lets see if they provide it within the S.A.R? Bet you they dont.

How many threads on here postggi are S.A.Rs complied with??

In any event im sure the OP is looking to have this CCJ set a side to be able to re defend it and the above request is how I would initiate it.

Regards

Andy

Regarding the questions u asked

Yes the solicitor was a Mr cohen from west yorkshire.

as for the attachment of earnings,i am not sure where it came from as i can't find the paperwork,i could ask the guy at work who does our wages, would he know??

What do you think i should send them?? a cca or the other one,i am not that good with legal stuff so i really have no idea.

i believe i did sign a new agreement,so have i re-wrote the loan, and what does that mean for me?they said they would add the outstanding from the other one,to the new one,i'm sure thats what they said, but it was in 2002 7 years back, and i cant find any of my agreements,i know i have kept them, just not sure where (DOH)

andyorch "is looking to have this CCJ set a side to be able to re defend it".Yeah this would be what i would like to do.

Is there anyway i can get a copy of the agreements i have made with them??

Is this the welcome finance forum

I would request both then you have all bases covered,Only costs a £1.00 PO.Leave the PO blank just retain your reciepts and proof of postage. They will not comply fully with the S.A.R but if they ignore yout CCA sec 77/78 request they know the law and would look excellent in your Defence should you succeed in setting a side.

Hi Smiffer,

Just to add my little bit. This is the Welcome finance forum.

Welcome Finance - The Consumer Forums

I must admit I agree with Andy and I think if you can afford it both requests is the best idea... I know for the likes of Barclaycard, that they don't think a SAR includes sending a Credit agreement so a separate request under a different act is always worth a shot.

Spam. :)

Ok so i am sending

an S.A.R request and a CCA? and am i right to just print the S.A.R and put my name at the bottom, and make the postal order out to welcome financial services??

What do i print for the CCA? and i leave the postal order for £1.00 blank?

do i send both of these to the address that postggj put in his last post here?

sorry to ask again, but i want to get it right.

I spoke to the guy at work who does the wages today, and he said the money is being paid to the court, and then it is forwarded to welcome finance,if thats any help?i am still trying to find my agreement/s as well but am not having any luck.
