Ok, simply put.

 

OC, passed on alleged debt to DCA.

 

DCA couldn't perform CCA request, so disputed account is in default. I followed through and requested Data removal etc. I'm pretty sure the DCA wants nothing to do with me now =D

 

OC has now sent me an Arrears notice.

 

Questions:

 

1) Do I write to OC to inform them CCA responsibility is still on DCA? Or,

2 a) Do I make a new CCA request to OC to ask for all infos?

2 b) What are my/OC's rights if they don't deliver on time? What are they allowed to do after the time has elapsed?

 

OC is egg pre 2005, so I should be in good standing.

Bumping this thread to see if any of the site experts pick up on it. From my perspective it seems that you have done a s.78 request which is in default & the OC have undertaken collection activity. I think your response should be to remind them that this is against the law. The responsibility for this lies with the OC & the DCA not you as the consumer.

What reply did you get from the DCA after you asked them to provide the CCA?

Normally a DCA has to ask the OC for the relevant docs when you ask for a CCA.

 

If that was the case, and the OC is aware of the request, then they are acting outside of the OFT guidelines, again!

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Just a shonky photocopy from the original OC - nowhere near what I had asked for.

Yep, as always.

 

As I mention, I think I'll be asking for full disclosure with regards to a possible court case, I'll have a good chance I think.

 

I will be moving to eliminate this alleged debt, not settlement.

Can you extend that elimination to some of their threat monkeys aswell!:D
