I took out a Masterloan in 2000.(£6000) I also took out insurance. When I lost my job I applied for relief because of the insurance but they said I had cancelled it. to cut a long story short the Ombudsman found in my favour.

They then sent me a cheque for app £1400 with no paperwork or explanation which I did not cash but asked what it represented and was that the end of the matter. No reply was ever received and I figured that was that. Now suddenly I am getting letters first from Hillesden and today from MDB , this letter finally stating its that masterloan. (£7820)

Firstly that was 9 years ago..and second the Ombudsman found them to be at fault and I heard no more..any suggestions please?

Did you pay in the cheque for £1400.

 

Are you saying you've heard nothing about this a/c in the last 9 years - if that's so, the alleged debt is clearly Statute Barred and no action can be taken to enforce it.

thanks for the reply. it took about 3 years from the start of the loan for the ombudsman to sort it out, and as i thought end the matter. the cheque was not presented as i could not get a reply as to what it represented. i have since moved and had mail forwarded but nothing regarding this matter. i note that mdb are using the banbury address and the diversionary phone number as well.

further, i did have a letter from hillesden maybe 6 months ago but as it did not state what it was about i took the cab advice and ignored it

Hi LL,

 

As you have not "acknowledged" the alleged debt in the last 6 years, either by paying towards it or agreeing that you owe any amount, then the debt is clearly Staute Barred by Virtue of the Limitation Act 1980.

 

You can safely write to Hillesden, MDB and anyone else using the info from the link I posted above.
