Where you on the inside or the outside of the bend?

 

Where there any speed restrictions in place?

 

If you wish to sue the council you will have to prove that they have been negligent in maintaining the road which could be difficult.

you should be driving in a safer manner for the surface you are on.

 

you have already admitted you knew it had been resurfaced, so p'haps should have been driving at a slower speed incase what has happened, had happened!

 

what are you going to write about?

 

dear council,

i was on one of your roads which had been recently been resurfaced & because i was going too fast, i did not brake in time because of the loose gravel, oh and the road is too narrow for two cars to pass, oh and i live in this area so i know i cant pass another car.

 

its your car, you should be driving it in a safe manner dependent upon road conditions.

so basically

wrong place

wrong road

wrong time

very unlucky.

 

was the other guy doing the same speed too?

 

signage might play a part here then?

 

slow 20mph loose gravel things

blind corner

single track road

 

yes i did presume speed.

 

i am wondering if you were both then only doing 20mph, if you do have a case against the council or highways for too much loose gravel.

two people are better than one if a claim like this.

well, i expect as you, have seem road sweeper dealing with too much gravel after the road has been done. bit like clearig mud up.

 

i'd post up the photos.

 

some really knowledable members i'm sure will look in when work finishes

if you have the photos up it might well help.

 

i think it is resonable for two cars to be able to stop on such a road, so there must be a 'something' that stopped this happening, could well be lack of grip through to much loose gravel. else the road would be signed a bit better if lots of crashes happen because it is 'just' dangerous.

dx100uk, do you not have better things to do? Did i mention the speed that i was driving at? no, so dont persume that i was driving like an idiot.

You persumed that i lived in the area, so knew the road. Not true.

 

theclaimbroker, i was on the outside of the bend driving in second gear at 20mph. Suing the council wasnt necessarily on my agenda, as i understand the complications it would involve.

 

 

Please don't be put off by the trolls

 

Can you be more descriptive of the road width etc & it's condition at the time - When you say it had been resurfaced then when approx & were there any signs indicating loose chippings & what is the speed limit

I cant remember seeing any signs, ive been searching through my mind and i really cant remember seeing any at all.

The other driver said he was doing around the same speed, this is why we had both agreed it was 50/50 liabilty although both of us are cheesed off about the road surface and feel that had there been a better surface then we both could have stopped in time. I have photographic evidence of the state of the road, and the positions of the cars after the collision. Do you think i may have a right to question the council over the condition of the road surface?

 

 

Yes you can - Also the contractor who resurfaced the road is duty bound to return very soon thereafter to ensure that any loose surface debris is removed this should be in their diary - but often this doesn't happen for one reason or another but still it's the councils responsibility to ensure it's done

having download, zoomed and look at the one photo so far.

 

there is no sign to me that there is excess gravel nothing on side of road or splattered in grass etc.

 

there is also no sign on the skid marks of dragging nor rutting which would show movement of loose gravel.
