Hello people

 

Not great at working my way round on here so can anyone tell me the address to send a cca request to the barclays bank please.

 

Also i could not find a template letter to cca the bank, i could only find a template letter to cca a debt collection company. Again any help appreciated please.

Hi again people

 

I am asking this question on behalf of my sister who took out a bank loan a few years ago over the internet.

 

They sent her a cca which she never returned and although she is now sending them a cca request i was wondering if there was another online based method of them saying she took the loan out.

 

Any help would be greatly appreciated as she is stuck in a bit of a rut at the moment

Hi, andy.

 

A tick in the online application box is an accepted 'signature'.

 

As The Consumer Credit Act 1974 (Electronic Communications) Order 2004 came into force in December 2004 any online agreements entered into prior to this date still need a signed executed credit agreement.

Electronic signatures weren't considered valid until this date.

Hi Angry,

 

Before you fire CCA requests off in all directions, are you clear on what type of a/c, or loan a CCA request is used for. You wouldn't usually use a CCA request for a bank a/c even if it is o/drawn.

I thought their might be something in it but if this is the case why have they sent her a cca through the post for her to sign.

 

I don't understand it but maybe you can explain please

Could you please expand on what you mean.

 

This was a loan done over the internet about three years ago.

 

Please help if you have any information.

 

As you can probably tell i'm a bit of a novice when it comes to things like this although i did get a £9000 loan wiped out for my partner when Moorcroft where on her back.

 

Any help you could give would be welcome and thanks for your reply.

Hi Andy,

 

As a loan a/c done over the internet, the electronic tick would be taken instead of a signature, as Maroon said above.

 

Read through Link No5 in my signature below. It's a good guide to Credit Agreements.

 

Do you think there are any penalty charges on the loan a/c for late or missed payments. These could be reclaimed to reduce the a/c balance.

Ok thanks slick.

 

This loan was a consolidation loan which she got out a few years ago but the original loan was done in 2003.

 

Now as moroon says if electronic signatures where not valid until 2004 do you think she might have a case and if so what sort of letter would she send to the bank.

 

Hope you don't think i'm being arkward but any help is of great use to me.

I believe the consolidation loan will be treated as a new loan from the date it started and the "tick" will be accepted in place of a signature, according to the date you suggest - ie approx 3 years back.
