I've been a bit bored so I've just been trawling through my Equifax file while I wait for several s.78 CCA requests to come back (we're about half way to deadline).

I've noticed that there are two "outstanding debt" searches on the Equifax file at my last two addresses. I've been searched by Mackenzie Hall (the lover of debts older than Methuselah) & an outfit I've not heard of before - 1st Credit. I've no idea what these can be for.

The Mackenzie Hall search in March hasn't resulted in any contact from them. The 1st Credit search was done on Monday so could still hear from them I suppose.

Now MuckHall have a reputation for dodgy dealings; they been censured by OFT once this year already -

The Office of Fair Trading: OFT imposes requirements on Mackenzie Hall to improve handling of disputed debts

So I may do a SAR on them just for the hell of it. Does anyone else have any thoughts on how I can get this search removed? I think debt searches stay on files longer than credit searches (is it 2 years instead of 1?)

The 1st Credit search has got me thinking. All of my defaults are now technically "in dispute" as I have outstanding CCA requests with the exception of Barclaycard (which is eighteen months from statute barred deadline). So if it is a search in relation to Barclaysharks, I will need to deal with this too.

However, if I find out that this search was undertaken for one that I've done a s.78 request on, what recourse do I have here?

thanks guys, EC

I got warned that I may get picked up on someone's radar for this when I started challenging things

CRA and DCA's all pee in the same pot. By looking at your file you trigger the DCA's. They think you have something to hide because you are checking the CRA file. You have alerted these cretins that you are concerned about your credit file so they in turn will see what they can dig up on you. Why do you think it's always advertised on TV, just so that you can improve your credit file, definately not.

Please check & see if they have your consent to check your CRA file as making a CCA request does not constitute such consent - Searches can only be done if they are acting for a creditor as they rely entirely on that creditors T&C

I strongly disagree, I check mine for other reasons, namely ID fraud, and I have been for over 5 years, it has alerted no-one, and yes I did owe in excess of 40K.

But thanks to the self elected Government, it's all been paid back using my money now any way!

I'm not saying that what you are stating is untrue, but along with the whole issue of whether or not it is advisable to sign letters to DCA's for fear of them committing fraud, it is unfounded and I have yet to begin eating my hat after being shown any evidence to the contrary.

A lot of our fears and concerns are what we either read or hear, not what we actually see and can prove.;)

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Damn! I must try harder:D

Short of ringing them up and saying 'I am here' seems to have no effect:confused:

Documents with allegedly include cut & paste signatures DO exist - However for obvious reasons they have not been posted on an open forum ......also there has been no prosecution.........yet

There are several cases on here of people applying for credit files and then being chased when all was quiet before. A very good friend of mine told me he applied to experian so I warned him what might happen, and sure enough it did. Again he had previously been left alone. The debt that was thrown up was over 5 years old and he only wanted to check when it would clear. Also I'm sure I've seen somewhere that directors at experian are also linked with several DCAs

The guys on here are dead right. Both of these searches have thrown up dormant accounts approaching statutory deadlines. More tussling ahead!
