      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am in a bit of a pickle at the moment with BC. I recently found out that I had PPI on my card for 2 years.... totally without my knowledge. This is a snippet from a question I asked in another thread of mine and one of the guys recommended I post it here. You can get the jist of what I am talking about....

 

Is it still classed as mis-selling when they do something 'Under the radar' in relation to PPI.

Heres how I see it. They stole money off me for 2 years - someone noticed they were taking this money from me and then tried to cover it up.

I also just noticed on one of my statements that one of the PPI payments pushed me over my credit limit leading to LOADS of charges (and interest on those charges). Surely this isnt right is it. Like I said I use to just get the letters and statements and stick them in a folder and becuase I used to earn a decent living I just didn't realise these things were there but now money is tight it has been brought to light.

Wow I cannot belive this company. I cannot wait to see what they come up with for this.

 

 

I sar them recently to see the info they have on me. Is it not criminal for them to just stick PPI on to my account notice it 2 years down the line and then brush it under the carpet.

You have started with the right approach Subject Access Request. Get the information and then action. In the meantime please read through some of the threads in the stickies at the top of the forum which may help you prepare.

If you have been paying for PPI and were not aware of it then Yes you should be claiming it back with the interest. Keep copies of all of your statements you will need to either send copies to the FOS or present them in Court if that is you chosen route to get your money back. It seems a lot of people were not only mis-sold but a lot more had PPI added to their loans without their knowledge (a serious state of affairs and how to prove it) :-o

hello all.

 

I SAR'd Barclaycard becuase I noticed several discrepencies with the account. I am going to be reclaiming my charges back from them to start with and alongside that I am going to go fourth and claim the charges for the card protection that I only recently found out were added to the account in 2007 and 2008. They have not sent me details of this (only in a statement recently cause of SAR) and I want my cash back.

I have no idea of the policy number becuase I never asked or recieved for it and I am unsure what to put in the letter or indeed what interest I can charge but I will get to that point in a moment.

LETTER - Most of the templates I can find on here are all referring to Loan polices / PPI where this Card protection is for protecting the loss of cards etc so am unsure how to approach it.

INTEREST - I know with disproportiante charges for banks, cc, loans etc I can initially ask for the statuary 8% interest rate; what a court would award. But the problem I have is along with the money taken out for the card protection in 2007 - 2008 on both of these occassions the money taken by the sharks put me over my credit limit (which in turn caused for me to be charged) and they then added contractual interest for the next month on the over limit amount which I feel should not have happened.

To cut along story short. They cause me to go over my credit limit, they then add charges and they then add the interest to this also. I would not have gone over limit and I would not have recieved the added interest etc.

Any ideas on the best way to approach this as I will want to send them a letter asap.

I believe you will only be able to claim any insurance that was the result of you not being able to repay the monthly payment on the card because of illness, job loss etc. IMO you would not be able to make a claim for insurance for the loss of any card.

I think you may have missed the point. The card insurance is a product that was added to my account without my knowledge and it is something I have only recently discovered was there as in my post above. Surely they can't just go around taking money off people for things they have not asked for or even made aware of. If they would have offered card insurance I would have refused but the fact is they put it there under the radar so to speak which personally I feel is extremley underhanded. If I had lost my cards I wouldn't have been able to claim as the simple fact is I wasn't ever made aware that they was covered nor is it a service I had ever bought.

I think you may have missed the point. The card insurance is a product that was added to my account without my knowledge and it is something I have only recently discovered was there as in my post above. If they would have offered card insurance I would have refused but the fact is they put it there under the radar so to speak which personally I feel is extremley underhanded. If I had lost my cards I wouldn't have been able to claim as the simple fact is I wasn't ever made aware that they was covered nor is it a service I had ever bought.

 

If it was added without your knowledge then yes claim it back. As you rightly point out you should not be paying for something you did not request at the point of application. Forgive me for just having my PPI hat on.;)

 

Having said this you should still submit a SAR to ensure you get all of the data/evidence to enable you to make a solid claim. It will then be up to barclaycard to prove otherwise.

They were denying till I got copies of my statements through recently that it was ever on my account (the statements say otherwise though) and it is clearly stated that they have taken payments out for this card protection. They have yet to produce any info relating to my aquiring of the card protection. Why Barclays keep on getting things so completley wrong is beyond me. They say I should recieve my CCA and application form through by next friday as my SAR to date was incomplete so I will see what they say but in the meantime I am going to go after the money. Any ideas what I can do about charges specifically relating to over credit charges caused by monies being taken for card protection????

I am not up to speed on the credit card charge issue but if you search the CAG site (there are many forums I am sure you will find someone in the know) If they fail to produce the required info on your SAR then this would be your next step.
