Possible unenforcable credit agreement?

Hi, I currently have a credit agreement (loan) with Lloyds TSB and I am wondering if it is unenforcable?

 

I really have been treated appallingly by the above company as I asked them 3 times for help and they refused (claiming interest rates) even though I was struggling financially (to which they just shrugged their shoulders).

 

I then had to go with a debt management plan through another company. But Lloyds TSB still harassed me even when I was in the plan.

 

I read the unenforcable credit agreement thread, but I had difficulty understanding it and am wondering if someone could help me to understand it?

 

I have recently won a case against them for missold PPI (I don't know if this is relevant?)

 

I would be extremely grateful for any help.

Have you sent the CCA request off for a copy.. or maybe you already have a copy and can remove personal details (using a site like photobucket) and post it up?

 

Loans tend to be pretty solid (compared to credit card agreements) for the most part but not always, depends on when they were taken out.

No not yet, how do I go about doing this? My loan was taken out in 2003

.Hi all another one of my many problems with LTSB (who I had loan problems with) and AIC (who the loan debt went over to).

 

I called the debt management company yesterday (who took over my debt in 2006)

to update me as to how much is left to pay and I was quite shocked as the figure did not add up to what I thought had been paid.

 

The outstanding figure is way more (about £4000 more) than my calculated figure left to pay. :???:

 

This has now got me thinking, have Lloyds TSB given false information and AIC received this information?

Or have AIC taken money somewhere without consent? :-x

 

I have sent a detailed SAR information request to AIC because I am now suspicious but need to know what my options are

and what to do now or next or when I receive the information I want?

I forgot to mention that I contacted LTSB and they had no record of my loan (which is why I contacted the debt management company who gave me the details of the outstanding balance).

Who owns the debt and does it show on your credit reference files?

Only from the debt management company, the debt is with Lloyds but as I mentioned they have no knowledge of it.

 

Where do I look for credit reference? Somwhere like Experia?

Something certainly seems amiss here, so you need to know whre the

payments are going.

 

For Credit refs use both Experian (Credit Expert) and Equifax the to largest

agencies, they both have 30 day free trials, I say use both because not

all credit us the same agency.

On checking my experian report the Lloyds TSB bit still has the loan to them but when I checked with Lloyds TSB yesterday they had no record of my loan.

 

Even so they also have a slightly different figure from what I was told...

 

What shall I do now as this is getting slightly confusing?

 

On the plus side my credit rating wasnt as bad as I thought it was...

And the figure is not reducing even though you are paying,

Yes they are all there.

 

How would I do it myself?

 

Something along the lines of cancelling the payment/agreement with them and wait for the inevitable letters to arrive and write back with offers or stated payments?

 

I might need a bit of help with wording the letters and what to put if thats ok?

 

I only went with them as I had no experience of dealing with debts and creditors etc but then again I didn't come across this site until 2009.

OK I've written out both letters to both firms and I'll be sending them off tomorrow.

 

Sorry what are T & I's?

 

As far as the debts go they are Lloyds tsb loan (obviously) for £9192 and HSBC over a unplanned overdraft for £884 which is mostly HSBC's own charges...
