I have just this week been diagnosed with Brain Calcification , whoopee on top of all this. Side effects are unbelievable, check it out. Seems ive had it for a number of years , it explains lots of problems ive had.  
    • Hi guys No letters recieved as yet,  the only update is the gaffer now knows about this demand , im sure you can imagine the crap really hit the fan.   The only thing i have found out is the LAA have a complaints department and a complaints system thats supposed to be followed. OOOPS  I suppose im not alone in this predicament.   Had i realised it was going to come to this id have told the lawyers to do one.    Keep safe ya'll .
    • Ive opened new bank account etc now so sorting out to get our money etc paid in there . Im then going to cut off contacts with old bank and other debts and apply for DRO . But do i add paypal to the list for DRO or forget about paypal like you said in other messages ? I just want to make sure because i dont want to apply for DRO and then later on paypal comes back to bite me and then i wish is added it . Sorry to be a pain guys but I just want to make sure and to date ive not had any letter or anything from paypal just couple of emails

    • 12+2 working days.   a dca can't hurt you credit file any more anyway.   only the original creditor can issue and register a default, on or before the sale of the debt.   what the dca put in the calendar section is immaterial as only you and them can see it it does not extend the 6yrs period whereby the debt shows on your file and after which the 6th defaulted date's birthday causes the whole file to removed regardless to paid or not, paying or not......makes no odds. it still goes, but might still be owed mind, depending upon the contents of the CCA return.   dx

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Barclays claim is partial success

I assisted my daughter in a claim for the return of £2100 in bank charges from Barclays, Cwmbran, Gwent. She also put in an application to the small claims court. Both the bank and court sent her an assement form to be considered as experiencing hardship. On receiving the form, Barclays credited her account with £1458 within a few days. Additionally, my daughter received a letter from the bank stating that they would further pay the difference up to the full claim if ordered to do so by the court. We are just awaiting the courts decision as to whether she has to pay the up front court fee. Looks like a good result so far! :)

Congratulations on your daughters claim. Would you be able to give a few details of her circumstances which may help guide others as to what Barclays see as hardship.

 

The courts assessment form - I presume this would be the EX160 for remission of court fees.

Sure, she is a single mum with a six year old child who gets free school lunches. She gets council tax benefit (all paid). She gets some tax credits but I'm not sure what. The only work she does is that she is under contract to social services for one day a week escorting young offenders. So basically income vs outgoings.

As for the courts form I don't remember the number but I think you are correct.

Great thank you. Did she have any priority debts or was it simply a case of essential outgoings exceeding income ?

 

Good on her and hope it really helps her get on top of things.

Yes, she had other debts (which she didn't tell me about until after) so I guess they were possibly an added factor. Now she is all square so when we all finally win the appeal, and she gets the rest, she will have some spare! (Perhaps I will get a drink out of it ;0).
