MBNA Called me today to ask why i am saying my account is in dispute.

I told them to refer to my letters and they said i am wrong and need to pay.

They eventually said they sent me a cca copy on the 16th june, when i said i had not received it and could they re-send it they said no!

 

where do i stand?

they also wanted to make me aware that they had won 3 court cases recently!

They may well have won 3 cases recently but how many have they lost?

Loads more I'll bet.

Let this be a lesson to you, NEVER TALK TO THEM ON THE PHONE

 

They will intimidate you with untruths and bullying

 

While they haven't supplied your CCA, the account is most definitely in dispute.

You could do.

If you haven't formally put the account into dispute,do so but put a bit about not receiving the letter (allegedly) sent on the 16th and you could even offer to collect it from a local branch

If you are asked to deal with any matter via private message, PLEASE report it.

Hi,

It looks like you took this out online.

 

The Consumer Credit Act 1974 (Electronic Communications) Order 2004 which came into effect in December 04 means a tick in a box is enough to say you agreed to the terms and conditions.

 

In my opinion, it is enforceable. Sorry.
