can i claim ppi on first original loan

reading one of alanalana post , i have only just realised the ppi fight i am having now is on a top up from the original loan, which has to be paid off before you get the rest of the new loan, i don,t remember when i first took out the first loan ( before 2004) or where the paper work is , can i claim ppi on the first one ,it must have had ppi on it , is there away to get the details ,and is there a time limit to claiming ? the first loan was for £10,000 rosie posie:confused:

i'm trying that game with HFC now

they are screaming 6 yrs limit, exactly the same situation as you , infact it was a triple top up going back to 1998!

not got anywhere so far, they deny all knowledge of the other loans, even though i have all the agreements

We have several old loans with LTSB dating back to 2000 approx. We contacted them specifically about two of these and even sent copies of the original CCAs, which we still had, as well as copies of statements relating to these loans which LTSB had recently sent us in a SAR.

 

On three occasions LTSB merely sent all our paperwork back saying they couldn't trace the agreements or the customer:eek:

 

I am convinced it's because they think as it's outside the 6 years they don't need to investigate (although they didn't say as much) - but they're not fooling me with that one - PPI complaints can stretch back as far as the date of the loan - it's when you discovered it had been mis-sold that matters.

 

Today we called the FOS as we were at a loss how next to continue as the 8 weeks is not yet up and they said they would chase LTSB for us and hassle them into looking into our complaint.

 

They told us it was irrelevant that these loans were from so long ago - mis-selling is mis-selling how ever long ago it was the FOS guy said.

 

So definitely pursue it and if you get fobbed off give the FOS a call, they were very helpful and understanding we found.

After a long battle got mine back from Direct Line Financial Services 4 loans all refinanced (now RBS) plus RBS 3 laons all refinanced and went back to 1997. Keep up the pressure the banks keep records for ever and a day you could actually ask to pop into your branch and ask to see the records. Which would give them a bit of a suprise:eek:


I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
