    • The Legal Ombudsman has a wider remit than the SRA, and can always refer matters on to the SRA where they find a breach of the SRA's code.   I'd suggest writing to the solicitors, highlighting these issues, asking them to refund the money. If they don't then complain to the LO.
    • Good morning all,   I have an update for you all, shortly after my first hearing i was told i would need to have a rehearing with another company, Obviously i agreed but after the initial grievance hearing the person then asked me to enter into a private conversation, I have received the settlement offer and are disgusted as its not even half of my monthly  salary, I'm not sure what to do at this stage as i dont have the funds to finance a solicitor,so any advice would be appreciated.

    • I understand that you were involved in a contentious divorce in respect of which there was a bill for court costs – £850. You decided to challenge the costs in court and you lost and an order was made against you. We decided to appeal the order but before the appeal was heard, the solicitors made you a without prejudice offer of a 50-50 split – £425. You agree to this and you signed the document to that effect which you returned to the solicitors. Despite that the solicitors are now trying to impose the original £850 order. Is that the correct order of events? "Without prejudice" is certainly something that doesn't seem to be very well understood, including by solicitors. "Without prejudice" can protect an offer from being disclosed to the court where the offer has been refused so that it is not binding on anyone. However, without prejudice cannot be used to hide everything from the court – including wrongdoings, unethical behaviour et cetera. It seems to me that once you sign the agreement you effectively had a contract. I'd like to know a little bit more about the agreement that you signed but presumably it was intended to bring a halt to any further proceedings. I don't think there is any difficulty about disclosing a contract to the court in the circumstances. It is only the offer which was made without prejudice. Once the agreement was accepted and signed then the document acquired a wholly different character. It was no longer an offer open to be accepted or refused. It was a legally binding contract which imposed obligations upon both sides. In my view the solicitors have acted in a highly unethical way and I would begin by making a complaint to the SRA. I wonder whether the solicitors proposed the 50-50 split to you without consulting with their client and when they then contacted their client and told her what had been agreed, she refused to accept it and on that basis the solicitors recognised that they had made an error but rather than accept their responsibility and footing the £425 out of their own pockets, they preferred to get it from you. Of course this is just speculation but it seems to me to be quite a possible scenario. I'd like to see the agreement post up here please – that my sense is that you should complain to the SRA and you should tell the solicitors that this is what you're doing.

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Hi im new to the forum so i dont know how to start my own post i to recieved a PCN and after looking at the information on this site decided not to pay the fee i later recieved letters from solicitors and debt collectors and ignored those too.

today i recieved a new letter from legal services commission stating that the amount has gathered interest and now stands at 3505 pound admitedly ive **** a brick and desperately need some advice to make matters worse im out the country for 3 weeks and the interest on the ridiculous amout is 54 pence per day. should i still be ignoring these letters because they sound serious now.

The charge was made when i parked out of a bay in a office complex whilst nipping into greggs. the original fine was for 60 quid increasing to 90 after 14 days.

originally i did send a one of the letter templates found on an older post to the solicitors and they ignored it and sent me further letters with addtional charges. apart from that this is the only corrispondance i have had with the bastardos.

 

Do i have to pay?

 

Should i contact them?

 

Please if anyone can help it would be greatly appreciated.

are you sure its from Legal Services Commission

 

they dont get involved in matter like these

 

who gave you the original ticket

 

can you scan the letter taking out the personal details and post it

£3505...? £3505...? Thats got to be a PPC.

It'll be a ppc with a dubious logo on the letter to make it look more official.

Ignore the tossers.

Who gave you the original 'ticket'?

If it ever went to court (which I doubt if it's a ppc) they would surely kick it out.

That amount of money for a charge is, I would suggest, extortion.

unless some DCA is running a scare tactic [problem], and trying to scare the OP

as far as the Legal Services Commission goes this is their website, which is related to Legal Aid , they would not be involved with a parking ticket,

Hello everybody

i just want to appoligise for putting this post up it turns out the letter was for my mums divorce costs and i just wasnt being intellegent. However i am still recieving letter from graham white solicitors i have had a few stating what the charges are and that they need to be paid in 7 days after about 3 of these i have recieved one today stating it is the final warning.

 

it says.

 

take notice that despite many attempts to obtain payment from you you have chosen to withold settlement of the ammount stated above (140 quid)

 

we have already fullfilled all legal requirements in relation to commencing litigation.

 

if you are in any doubt as to the seriousness of this situation you should seek independant legal advice, as the consequences of litigation can be far reaching such as:

 

- substantial legal costs and statutory interest being added to your debt

- your name being listed on the register of judgements affecting your chances of further credit in the future

- seizure of your assets by Bailiffs

- An order to obtain information from judgement debtor

 

it is your responsibility to repay this account to us immediately, and we put you on notice that we shall parefer to the matter in 7 days.

 

please be assured this matter will not go away without solution or resolution.

 

if you do not wish to incur the consequences of court action, you must pay the amount claimed immediately. if you cannot pay the full amout, or if you have valid defence to this claim you should call this office without further delay.

 

 

So basically thats the letter barring ofcourse my adresse name and other personel things i hope somebody can shed some light on the situation and the actual 'seriousness' of the situation.

 

once again im sorry for causing ripples in the CAG it was the night i was due to go away and i obviously **** a brick.

 

id greatly appreciate any help on the matter or even info from people who have been in a similar situation. thanks everyone for your help

as for LDK security do a search on here for them , you will find all about the [problem] invoices they send out

 

and the one word you will always find "IGNORE"

I arrived home about one hour ago, to find a letter with exactly the same words!

 

Mine is in a tray with their previous letter, headed "Notice of intended legal action", and one from Roxburghe, and one from Central Ticketing.

 

I'm going to ignore them, shall we ignore them together?
