    • at this site they would still beat off a court claim due to the contract with the landowner being faulty and with another company. If they had read other threads and the parking pranksters musings on this place they would be bouyed by all of the info and be up for it.
    • Are you definitely the registered keeper and do you have the V5C showing that you are the RK?   It can happen that you can set up a DD without being the RK, but if the DVLA do not have a RK recorded against the car when it comes time to renew, then the DD will not renew.   If the vehicle keeper does not have a V5C Your Direct Debit will not automatically renew if there’s no vehicle keeper in DVLA’s records. You can tell DVLA who the vehicle keeper is online. If you do not get an email or letter when your vehicle tax runs out, you should contact DVLA   https://www.gov.uk/vehicle-tax-direct-debit/renewing     Could this have happened in your case?  It usually happens when you bought a car a year ago and set up a DD to tax it before you actually get the new V5C through.  You then either "forget" to get a new V5C, or you do try to get one, but it never comes through because your application has got lost, and you never chased it up.
    • Do you have the written copy of the order from the court which should have been sent to you after the court hearing?
    • TMB took me to court to repossess a buy to let property I own. We went in to court and I explained that I had found a good tenant and would hopefully like to keep the property, I explained that the mortgage of £543 pcm would be given straight to TMB directly through the tenants rent payments. This was agreed by the solicitors representing TMB. The judge explained that as long as I paid the mortgage repayments there was no chance of TMB repossessing the property. I explained that as the rent was £600 pcm I would pay the full £600 to TMB thus reducing the arrears. The judge stated that he would only put down the monthly mortgage payment and if I wanted to pay the extra that was fine. I continued to pay this until September 2018 when I was was contacted by TMB who stated the interest rate had gone up and I was £35 in arrears and the payment was now £635 pcm. I paid the difference and took steps to make sure this didn't happen again. I was also sent a letter in late September 2018 stating that I hadn't kept to the possession order and I was in a large amount of arrears. I telephoned them and was told there were two different orders, one to pay the monthly payment of £535 and one to pay £600 pcm. As I was paying the £600 the second amount of £535 was to be paid alongside of the other. I explained that there was only one court order and I had fully complied. I was passed from one department to another whilst being told "it was an easy mistake to make" but the amount needed to be cleared. I have been chased for the outstanding "arrears" and have had companies visit my tenant explaining the property was to be repossessed.  I have also been made to pay £185 on top of the  rent payment to reduce the arrears I owed from before we went to court. all under the priviso that the property was to be repossessed I have kept to the judges order but have found TMB to be  acting against the judges order. What if any are my next steps? Thanks

I can't say, All I got back from Welcome in reply to my SAR was a photo copy of the original agreement, plus those two same day dated letters ( response/final response ), nothing else.

That's what prompted me to contact AVIVA.

 

I sent Aviva a SAR on 3rd of this month so maybe this cheque is an attempt to get the issue out of the way without any further ado.

 

The other thing is I originally asked Welcome to investigate the complaint under the Plevin rule.

I seem to remember an earlier post when I said I had worked the PPI out to around £700.

But as all doc's have gone I'm at a bit of a loss.

 

I'm not going to cash the cheque yet as it may be viewed as accepting their " offer ",

I'm hope the letter they mentioned turns up tomorrow.

 

If it doesn't would you recommend holding back until the SAR stuff arrives.

Here is the letter from AVIVA, you'll notice the amount under " other " for £170. This I remember was for health care. Given that PPi was put on the acct why would health care be needed. I'm still waiting for AVIVA to reply to my SAR request, that deadline is 4th August.

I sent further SAR..06/08/2018 requesting copy of agreement which states " healthcare "

but still have had no response from AVIVA, ( they signed for it 08/08/2018 ).

 

As the amount is £170 and the interest over all these years could come to a fairly large amount

 

do you think this is why AVIVA are ignoring me.

I phoned the ICO and they said to complete a complaint form.

 

I just checked my email and found a message from AVIVA,

they've sent a document which is a breakdown from Cattles data which shows Medicare for £170.

 

This together with the previous breakdown on the Statement of MIs-selling Redress which shows an item for " Other " for £170 surely proves that I was mis-sold health insurance...

 

Should I send all my doc's off to the ICO and wait for a decision

or do you think I could put in a claim for mis-sold health insurance.

 

Ideally I would like a copy of the doc' that Aviva used for their calculations to nail it down but they seem to be playing smoke and mirrors.

ask them why they have not refunded that too in the PPI reclaim

as normally its all counted as ONE sum inc healthcare

I was reading up post on healthcare and saw that you gave that advice to techcherry 30/7/17..don't know whether he took your advice. I'm fine with challenging AVIVA with the PPI/Healthcare thing, would putting a claim for the healthcare with spreadsheet be out of order.

Following up on what you recommended in post #84, I'm going to write to Aviva asking why they didn't address the mis-sold healthcare but how long should I give them to reply, given that they didn't respond to my second SAR until I threatened them with an ICO complaint.

I sent a basic claim letter but without a spreadsheet.

 

Just " I consider you have not treated me fairly, etc. and that I want them to refund cost of Healthcare plus the interest.

 

They paid back more than I claimed on the PPI so I'm hoping they'll do the same with this one.

 

I'm also going to post my progress with greedy pennies on that thread.

As I still haven't had anything back from AVIVA regarding the basic claim that I sent to them 11 Nov', not even a final response., would it prompt action from them if I sent in a claim for the Healthcare ins' but this time include a spreadsheet with the amount that I'm claiming.

Sorry I don't understand. I really would like to put in a claim but I don't know how to go about working out a spreadsheet with only one figure ( £170 ) to work with...with the compound method ( PPI ) each payment and date is entered and everything is automatically worked out. In this case I have one figure which goes back to 2001.

You cant claim compounded int with ppi

Fos questionnaire + stat int sheet

As per that guide before calc ppipcm payment

Treat healthcare same as ppi
