Hi,

I'm really hoping someone can help me. I have no idea what to do.

I have a debt of about 5 years ago but I last made a payment about 3 years ago. I am not living in the UK now, I have moved to Asia. The debt is for around 4,000GBP - stupidly, I've let this continue for this long. I am presuming this is what RED DEBT COLLECTION AGENCY is chasing me for. They haven't contacted me in Malaysia but they have managed to trace my Mom and are harrassing her via telephone! I haven't lived with my Mom for years and years and the debt was never under an address regsietered to her. Can someone help me with what to do? I only have a number for a guy called Mark at RED but nothing else. It's hard for me to call from here as I'm 8 hours ahead and costs a fortune to call those numbers but I'm worried because of them harrassing my Mom.

 

I would appreciate advice on what to do!

hi and welcome KatyKins

 

If I was in your shoes I would send the same letter that Cerberusalert has posted above but tailored to your situation. I would also consider emailing it to them.

 

What kind of account do you think they are chasing? It is quite possible that they don't have the correct paperwork / agreements to enforce collection:)

I would get your mum to send the letters back to RED marked not at this address and send them the telephone harassment letter (am not on my PC so haven't got it to hand.....sorry).

 

I would also ask your Mum to report these clowns to Trading Standards, OFT and ICO - at the end of the day SHE is being harassed by them for a debt that is not hers.

 

I would not bother with the prove it letter - the chance of them being able to enforce any such agreement in Malaysia is slim to none ;)

thanks so much for your replies. i'm so glad i found this site! i've been so worried all day. perhaps i'll give them a call and find out an email address i can use to communicate with them.

We'll start getting things into perspective now. :D

 

If you read through the site you'll find that Lowells & Cronies are not the brightest bulbs on the Christmas tree, they tend to specialise on uncollectable debts such as yours. For a start you live in Asia so it's highly unlikely that you'll ever receive a 'Doorstep Visit', well not unless one of the Leeds numpties is on holiday over there and decides to do a bit of freelance collecting to augment his holiday money. ;) Even if they did they would have absolutely no authority over there as no doubt there isn't any reciprocal agreements between the country you're in & the UK. All in all they are stuffed & if they continue to pursue you through your mother they will find themselves even deeper in the 'brown stuff'. Lowells are in the OFTs radar at the moment so if your mother has the slightest problem with them she should make a complaint to Consumer Direct Consumer Direct - Contact us & the OFT;

cerberusalert - I've had a good look through the site now and have seen loads of messages about these guys. I suppose my biggest concern is how they were contacting my Mom but thanks to everyones messages, I have managed to give her loads of advice on what to say to these rascals if they call again! I also sent them an email on Friday but haven't had a reply. Hopefully, I won't!

 

I do have a couple of questions. I'm not sure if you would be able to help or maybe you could point me in the right direction, of who might be able to?

 

- are Red / Lowells able to bankrupt me?

- i'm not able to attend any court hearing, if it came to that, what would happen?

- as I am in Malaysia, can they have me arrested or the like when I enter back in to the UK?!

 

Sorry if my last question seems rather far fetched but my imagination has been running in to overtime because of these guys!

Extremely unlikely - they cannot take court action against you in this country as you do not live here! Most DCA's use this as a threat and never ever go through with it. It's the way they work unfortunately.

Any court action or enforcement action would have to be done in Malaysia - they have no chance as the CCA cannot be enforced there. IF they try and get a CCJ in the UK by default, then you can apply to have it set-aside and more than likely struck out as I can't see them paying money out to take you to court where you are (it would cost them a fortune, far more than you owe)
