    • ok again thanks for all advice , im going to continue and struggle on paying the wifes debts and maybe look at getting reduced payments but as for mine i think ill go down the DRO route and try get it sorted but will see and open new bank account somewhere first
    • Nothing to do with your own Bank.     Try to withdraw the money from Parentpay early next week and if no joy contact them.   It may be that the money is showing, but has not fully cleared on their system,

These terms are from a contract at a similar time to when Tracey started as we think they have changed since.   The contract reads as follows:   Termination of employment  Xxxxxxx (Nursery) will provide written notice of termination of your employment in accordance with statutory requirement (currently 1 week’s notice for each year of continuous service, up to a maximum 12 week’s notice).   Once you have successfully completed your probationary period for the company you are required to give 1 month’s written notice of termination of employment.   Regards   Matt

    • I thank the Consumer Action Group Members for getting me this far in my case which is still in progress.   Situation: The Court has reversed earlier permission for me to rely on witness summaries.    The question upon which I am seeking help, please,  is - do I need to bother myself as to why the Court has reversed permission to rely on witness summaries?  If so, what line of logic or law can might I follow because clearly, the Court has said one thing and then another a few weeks later, of its own motion, the Court has reversed the earlier decision. I find this development quite extraordinary in the sense that as a result of being granted permission earlier, I served the three Witness Summons which had the Court stamp.   Background Having given me permission to serve 'Witness Summons' which I served on 3 hostile witnesses several weeks ago, the Court has now reversed it's earlier decision, and refused me permission to rely on 'witness summaries' pursuant to paragraph 32.9(2), citing that I have not shown steps taken to obtain witness statements from the 3 hostile witnesses.  I however, made two attempts to talk to the hostile witnesses who have been non responsive and I can evidence this.   I would be immensely grateful for some steer from Forum Members, please.

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Removing a Default Notice from Aktiv Kapital

Let me just start off by saying what a great resource this site is. I got back £1500 in bank charges from Barclays 2 years ago using the advice here; hopefully you can help again!

 

I recently checked by credit files and was shocked to see a Default Notice on there from Aktiv Kapital, who I'd never heard of, for £899 dated March 07.

 

I gave it a lot of thought and realised what has happened. I had a bank account with HSBC which I opened in 1993 and used very occasionally and was always overdrawn. I moved house in 2007 and competely forgot about this account. I assume that letters were landing at my previous address and as they went unanswered the Default was applied.

 

I've looked through all the forums here and think I have a good idea about asking them for credit agreements etc. but I was wondering if there's anything I can try without going straight down that route?

 

Do you think there's any chance I could get in touch with Aktiv Kapital explaining my mistake and ask if they'll remove the default in return for me paying off the debt? And if I did that and they turned me down, have I spoiled my chances of using other methods to get it removed?

 

It's amazing how anxious this sort of thing can make you feel, and I really hope I don't end up in court trying to get this removed!

This is CAG, we don't and never will look at anyone this way!

 

I bet most of what you owe are unfair charges anyway!

@havinastella, many thanks, glad to hear it!

 

I can't be sure as I don't have any statements from that HSBC account, but I guess I last paid money into it around the middle of 2006, and the default notice is dated march 07. I used to use the account to look after ebay sales and small amounts like that, I was sent letters quite a few times over the years reminding me that I had to keep making payments into it.

 

I remember I did go through my HSBC statements when I was claiming unfair bank charges back from another bank, but they amounted to quite a low amount (perhaps £100?) so I didn't pursue it. Could that make a difference?

Aargh, I really am an idiot, I just got my second credit reportback, this time from Equifax and there's another default on there. This time it's from T-Mobile for only £17! This was another contract I had at my old address, I don't really undestand what's happened here as I had a direct debit..

 

can anyone please offer me some advice, I'm trying not to panic now!

Have you checked if the Default Notice is valid? If you could post it on here we could take a look at it. If it is not valid and the debt has been sold to Aktiv Kapital, that is unlawful recission and with recission Aktiv Kapital loses any permission to process your personal data. As for the other debt, I'm sure you could persuade them it was an oversight on moving house and persuade them to remove the default.

Defaulted accounts are kept on file for six years from the date of the default, even if they are subsequently marked as satisfied by the lender.

The 29/09/93 date is when I first opened the account with HSBC.

No - a Default Notice is an actual specific document you get to say you have defaulted an agreement but if this was originally an overdraft you won't have been issued with one - overdrafts are at the behest of the bank and can be withdrawn by them anytime. I would send a SAR to the original creditor and find out if there are anymore charges to claim back. I don't know of any way to get the default off apart from checking that the details on the default were/are correct.
