    • Well done! This is more than likely the end of it, but you should check with the court at some stage that they've officially discontinued.   They can still chase you for the debt, and they might, but you can just ignore. If they were to issue proceedings again, you can refer to this case in your submissions - it won't reflect very well on them if their case is similar to this time. The chances of them trying again are probably slim though.
    • Send the AOS immediately with intention to defend.  Monitor this thread for a fuller reply lster or tomorrow
    • Update!!!    Email received from solicitors (well I was cc'd in on an email to the Court)   Notice of Discontinuance,   Does this mean it's a "Success" and no more to be heard?   Or potentially they could find the correct paperwork and start a new claim?   But, for the moment, I am happy.   Thanks for the help and guidance on this thread.
    • Hi All, newbie here, hope I'm doing this correctly.   Two years ago the wife was using my car and bought a ticket in a train station car park and displayed it on the dashboard. She returned to find a parking charge notice from Excel. It was a very windy day and it had evidently been blown on the the floor of the car as she left. It did not have a self adhesive part to stick to the window. I subsequently followed their online claim procedure and sent a copy of the ticket but the claim was refused. A couple of days ago I received the County Court Business Centre claim form in the post after presuming it would go away after not hearing from them for about a year (the usual threatening letters from debt recovery companies etc).   I wish I had paid the original £20 as this has been a big worry and hassle, but I just ignored most of the letters after reading stuff online. Obviously I want to dispute the whole of the claim but do I have a decent defence? I would cite the fact that the only reason the ticket was not displayed was that it could not be stuck to the window.   Any help and advice would be greatly appreciated.   Name of the Claimant : Excel Parking Services   Claimants Solicitors: Unknown   Date of issue – 08 July 2020   Date for AOS - 27 July 2020?   Date to submit Defence - 10 August?       What is the claim for – Breach of contract - parked without clearly displaying a valid parking ticket in Brewery St car park, Chesterfield on 02.07. 2018. Defendant has failed to settle the outstanding liability and Claimant seeks recovery of of the parking charge notice, costs and interest       What is the value of the claim? £185.00
    • I have had a letter from RBOS saying they have assigned my debt of £3600 to Cabot however it must be at least 6 years since i did anything with this debt, the letter was sent to my old address.   i have had a look around on the site but cant see a FAQ to do with these issues ( probably me not looking the right area)  .   can anyone advise me on what the next steps are as i assume this debt may be statute barred ? but im loath to ring Cabot and go through any details with them and would rather do it via letter.   as back ground i have other debts with other banks and currently have CCJ obtained via backdoor so im obligated to pay that debt. also did a stepchange thing that showed i have no other available funds to pay these other debts off.   any help appreciated

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Hi - I had posted this on an existing thread and some very nice people suggested that I start a whole new thread just for me - so here goes!:D

 

I am new to this PPI lark and I have just started the process with Paragon. I borrowed £25,000 from them in September 2004 and was charged £4,200 PPI which was added to the loan. Interestingly the loan was in joint names of my then partner and I yet the insurance was only in my name(?). I settled the loan in July 2007 and in the final statement was charged all sorts of settlement fees etc but received a rebate of almost £300 PPI premium.

 

I have written an initial letter stating that the premium should not have been added to the loan and also informing them that I had not been asked about exisiting health matters to inform the insurers. I have received a letter from Paragon - very patronising stating that they are 'concerned that I feel I have been mis-sold premium protection insurance'. They then inform me that my application was submitted by Loanmakers Limited??? All my dealings were with paragon - I have no paperwork from Loanmakers.

 

Should I continue to pursue this with Paragon?

 

I would be grateful for any help from anyone on the forum... you all seem very experienced in this. Thanks in advance

If your Consumer Credit Agreement was signed by Paragon on Paragon paper then Paragon are the target. They will blame the broker and vice versa. As you say you have no CCA with loanmakers, this is just another way for Paragon to try and avoid a claim on mis-sold PPI.

 

Paragon may state that the application was submitted by loanmakers but an APPLICATION is not a Consumer Credit Agreement within the terms of the Consumer Credit Act 1974.

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

I have had an acknowledgment of my SAR from Paragon stating they would provide me with the information within 40 days. I shall wait to see what they send me....

I don't think I have received anything like what I asked for. I will scan and post the letter and paperwork received. I notice that I received a one page 'application' from Loanmakers. it is a simple form with no signatures - just my details in type. I also notice that I have no policy documents for my insurance. I may need a lot of advice from you guys as to what I should do next. Will be back later with all the info.

Think I have got it! I received these together with a statement, payslip, some strange appendices and mortgage deed/charge. Any advice as to what I should do next is very welcome.

Blimey do you know what 180 payments of £355.35 comes to ? well i will tell you £63,963.00.

 

Oh and paragraph (B) that is all a load of bull because that commission you are paying so it is your data.

 

Paragraph (A) is also bull.

 

As it stands they have not complied with your request time to complain to the ICO and send another letter to Paragon.

PF - thank you so much. I assumed it was a load of BS but I needed someone to confirm. So my next stage is to write to Paragon stating that they have not complied with my request and inform them that I shall be writing to the ICO to inform them of same? Should I allow them time to rectify the situation or go straight to ICO?

Go straight to ICO they know the law and they have broken it.

 

As i have pointed out you are not only going for the PPI but also the commission they paid to the insurance provider.

 

Why should you pay commission that they should pay

To make a complaint to the ICO there is a form on there website just fill that in and enclose it with a covering letter.

Thanks again PF: I want to make sure that I understand what I am doing and why: I am writing to ICO to report that Paragon have not sent to me the information requested and there reason for not doing so are invalid? I am assuming that the idea is that ICO will 'make' Paragon release to me all information which they hold.

 

I am assuming that this will take some time and I wondered if there is anything else I can do to progress the claim.

 

I also wanted to know if it is worth engaging a consultant to progress my claim. Has anyone had experience of this?
