Hi a purchase I made had the incorrect label on according to security. No police involved signed a banning order and told RPL will claim damages and that if I didn't pay it would be doubled and if i didn't pay that a warrant would be issued for my arrest. Should I pay ? gut feeling says no. any help appreciated.

well as they didnt involve the police they would find it very hard to get the police involved.

 

also i would check with someone more knowlegable on the board but the threat could possibly be seen as blackmail

They can & the problem is the police will probably do their bidding - That said this may be a clear case of demanding money with menaces. In addition there are so many more reasons why it may be alleged that this company plus anyone else connected to their activities, including their clients may be acting unlawfully

A crime need not be reported at the time of it's commission - However & it's a big however if as RLP seem to imply their client will report the OP if he doesn't co-operate does mean the police won't be happy to be seen as debt collectors & nor will they be happy to be seen as being used as a form of coercion

 

& last but certainly not least the defence could argue that any evidence has now been tainted

This was clearly wrong and you was caught,but there was no loss to the company-and again £137.00 has not been substantiated as a genuine pre estimate.

You have been punished by a banning order and being humiliated for your actions in store.

The demand is consistent with all others,and shows that they maintain this is the cost incurred in every instance.

Our advice is not to pay until they provide conclusive proof that this fee is genuine....which we know they refuse to do.

Yes but its figures they pull from thin air.......the batteries in their calculator are well past being of any use.

:p get a friend to ask the security officer what his hourly rate is.

 

then tell retail loss prevention that they have made a mistake as they have charged £82 for the security officers work but hes only on £8.20 an hour theyve missed the .

Just to clarify, do you mean that

 

a)the item had an incorrect label on it when you pick it up to purchase it OR

b)that you switched a label to alter the price of the goods?

 

If its a) then its not your problem and would tell them to go whistle, how can you be responsible for their incorrect stock markups?

Actuallly Tk maxx can involve the police at any point after the event has occurred. It's not uncommon for Tk maxx to deal with an offender without calling the police if it fits certain criteria. One of these generally involves an admission of guilt, simply to avoid any come back to the investigator involved. It is perfectly plausible for the CCTV of this incident to have been retained to make future police and rlp proceedings easier.

Think long and hard about how innocent you really are before you tempt a police investigation. I've happily policed jobs months after the event when the offender has changed their mind about what actually happened...

The point I'm trying to make is that if somebody denies culpability to RLP, then generally RLP contacts the retailer (and the specific person involved) and will seek to obtain more details where relevant. When this has happened to me in the past and I've been told that the offender has changed their mind about the offence, then I'll always police the job (if it hasn't been done so already). That way a civil court case becomes a formality if a criminal case has been proven.

I know for a fact 110% that I will never pull a job unless I am happy to prove the case in court, therfore I've never had an issue to my knowledge where a civil case has actually been needed due to the offender being "not guilty". That is of course not saying that all the cases I've pulled in my years have resulted in payment! Just for the record also, the investigators for the company I work get 0 / none / zero kind of "kickback" from RLP for jobs.. Nothing. However in the current econmic climate, RLP is seen as an easy way to justify the salaraies of the security or loss prevention departments for the companies involved. Who wouldn't want a department that pays 15-30% of it's own way through it's day job?

the bottomline is RLP have NO LEGAL STATUS and with all the complaints the MOJ is now investigating them and the companies that use them, inc the databases they hold and share, maybe once the PLASTIC Security Staff and Companies relise they are NOT THE LAW nor PART OF IT, the better it will be, so many cases of security staff overstepping the mark and abuse of power, assult on the shoppers and the CRIMINAL DETENTION / SEARCHING of children to name just a few.

 

the stupid SIA Badge means sweet FA

 

its time the POLICE DID their Job

 

and the so called Security staff go back to their job of shelf filling,

Have to kind of disagree here. The security industry is, like every industry made up of people of varying standards. I think it would be grossly unfair to tarnish them all with the same brush. Just as it grossly unfair to take the word of every "victim" on this forum as gospel.

I am the first to admit that the industry has it's share of over-zealous, alpha-male retards that take up retail space. Generally these will always be in uniform, simply because anyone can be a uniformed officer. Are you aware how difficult it is to be sacked from a contract guard company, purely on performance? If the client doesn't like the guard they make a phonecall and another rolls on site.

What needs to be noted though is that for everyoe of the above, there is a responsible, proffessional person doing the same job for little or no thanks.

I have lost count of the number of times I've had a knife or syringe pulled on me in the last few years. Why? Because someone doesn't want to pay for something that doesn't belong to them and I have bills to pay... Oh and it gets better! Are you aware of the consequences for someone making a detention without cause? It usually all starts with a p45 and a black mark against your name in the industry you've spent your career in... Suddenly you wonder am I risking my job and my life to recover someone else's property? Does that excuse the mistakes? Of course not, but perhaps it shows that those people are human and under pressure to perform in a notoriously unsecure industry.

security staff are mostly "ronnie Mc Dee" rejects , christ in london most of them cannot even speak english ,

 

when the little dream world most of them live in burst's they might relize they are NOT POLICE or anything like it

 

come into the real world

 

I spent many years investigating fraud, difference was I did it legally, and was Under the Home Office, and had many run ins when companys started employing Plastic Policemen, SECURITY GUARDS needless to say they never won, against me when they fed me the usual crap they are taught
