    • Hi   I am sorry to hear of your recent loss   The Club I assume you joined would more than likely have had Terms & Conditions, Data Protection, Privacy Policy and did you sign any Agreement to join that CLub?   On Facebook did they actually Name (use your name) on the posts or did they use mum/mother etc?   As has been asked could you give us some background for your reason to send the SAR. If they have refused to give you certain Personal Data under your SAR request then I would suggest writing to them and refering to your SAR Request and their refusal to provide XYZ you requested and that you require clarification as to why this was refused and under exactly which Article of the General Data Protection Regulations (GDOR) they are relying on for this refusal.   The Clubs Constitution is only how the Club is setup you need to ask them for copies of the following:   Data Protection Policy   Privacy Policy (note the above policies may be on that Clubs website if they have one)   This link breaksdowns the General Data Protection Regulations (GDPR): https://www.privacy-regulation.eu/en/index.htm      
    • who assured you you'd get notification of no int time limit ending? thats not a normal MO of these BNPL agreements they are not onliged to warn you?   when did you rake this out and when did you try to pay the Org Sum?

    • Hi GB,   Welcome to CAG and I'm sorry to hear of your very recent loss.   I wonder if your brother or someone else could talk to your son and ask that he removes the offensive/libellous remarks.   When you refer to a solicitor helping, perhaps you mean help having the post removed, rather than taking action for libel, slander or defamation.

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Since last September I have been pursued by various DCA's with regards to a debt against Barclays Bank. The debt relates to an outstanding overdraft in the the region of £7000. This was left to me when my business partner went bankrupt and our business folded.

 

I wrote to Debt Managers asking for a copy of the CCA, (I know this isn't relevant to an overdraft but thought I would sent it anyway). The letter was sent on 25/04/09. On 06/05/09 I recieved a letter back saying that they had been unable to obtain a copy from their client (Barclays) and their file had been closed and returned back to Barclays.

 

Since then I have heard nothing. the debt is still showing as a default on me credit file.

 

I would like advice as to whether you think I should let sleeping dogs lie or to contact Barclays and try and draw the matter to a conclusion.

As they have returned your account back to Barclays, I'd tend to wait until they get in touch with you.

Can you confirm the nature of the debt, ie overdraft, loan, etc.

..... in which case, I don't know why Debt Managers returned it so quickly.:confused:

 

With a credit card or a bank loan a/c, there are v strict rules about the doc'ts needed to make the debt enforceable.

 

But with a bank o/d, there is normally very little in the way of paperwork and I suspect the bank, or a DCA, will come back about this quite soon, to collect what's due.

 

If this was a joint business a/c relating to a partnership (and not a Limited Co.), the bank will chase you for the whole debt.

 

You should use this quiet time to work out your best moves - I doubt they'll remain quiet for long.

I am also surprised too. I am aware that I am liable for the full debt, and it was a partnership. Although on any correspondance, including statements from Barclays it was only ever addressed to my partner and never to me. In view of this I am thinking that Barclays may have messed up on the administration of the account and this is perhaps why they have given up so easily on chasing the debt?

Sorry, I should have added, that I became a partner after being an empoyee for 20 odd years. that is why I suspect Barclays MAY have made administration errors by not adding my name on to this particular acccount.
