    • lookinforinfo - many thanks for your reply. It would be very interesting to get the letter of discontinuance. The court receptionist said that the county court was in Gloucester 'today' so that makes me think that some days it is in Gloucester and some days its in Cheltenham, it was maybe changed by the courts and i was never informed, who knows if DCBL were or not. My costs were a gallon of petrol and £3.40 for parking. I certainly don't want to end up in court again that's for sure but never say never lol. Its utterly disgusting the way these crooks can legally treat motorists but that's the uk for you. I'm originally from Scotland so it's good that they are not enforceable there but they certainly still try to get money out of you. I have to admit i have lost count of the pcn's i have received in the last 2 yr and 4 months since coming to England for work, most of them stop bothering you on their own eventually, it was just this one that they took it all the way. Like i mentioned in my WS the the likes of Aldi and other companies can get them cancelled but Mcdonalds refused to help me despite me being a very good customer.   brassednecked - many thanks   honeybee - many thanks   nicky boy - many thanks

This is nothing about paying just for what I use - I currently prefer the averaged monthly payment - else i wouldn't be in credit month after month - which I am comfortable with - else I wold simply request a part refund - which I  would have done if they hadn't reduced my monthly dd after the complaint I raised (handled slowly and rather badly) highlighted the errors in their systems (one of which they do seem to have fixed) Are you not aware DD is always potentially variable? ah well, look it up - but my deal is a supposed to average the payments over a year, and i dont expect them to change payments (up or down) without my informed agreement ESPECIALLY when I'm in credit over winter.   You are happy with your smart meter - jolly for you I dont want one, dont have to have one  - so wont   I have a box that tells me my electricity usage - was free donkeys years ago and shows me everything I need to know just like a smart meter but doesnt need a smart meter,  and i can manually set my charges - so as a side effect - would show me if the charges from the supplier were mismatched. Doesn't tell me if the meters actually calibrated correctly - but neither does your smart meter. That all relies on a label and the competence of the testers - and the competence of any remote fiddling with the settings. You seem happy with that - thats fine. I'm not.    
    • Evening all,   So today, I was sent an updated offer that includes the £12.60 I spent on letters, but they have declined to add the interest at £7.40. They have stating 'We acknowledge your request to claim interest to date, however, this would be at the discretion of a trial judge if the claim did proceed to a trial hearing.' I think I am content with this outcome, and pushing this to a trial for a total interest of £15.30 throughout the claim does not make sense to me.   What are people's thoughts? I am sure our courts have better things to concentrate on?

    • Have to attend the hearing and present evidence of his financial position (income & expenditure) and  statements ,and agree an acceptable payment plan with the judges guidance.  It will be a form of redetermination hearing as already stated.The court will not agree to bailiffs if the financials do not reflect it or assetts are minimal. They just want to determine his true affordable disposable monthly figure....which will not be £10.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all - I need some advise!

My stupid girlfriend swapped a price label in Tkmaxx and after paying for the goods (including other non swapped items) she was asked by two Tkmaxx employees (not security guards) to go to the store office where she was told that she was suspected of changing the price tags and she would be prosecuted. She was requested to produce an ID and give her personal details - name, address and date of birth, otherwise the police would be called. She only had her work ID on her and a credit card, these were taken from her into a different room - for her identity to be confirmed and checked over phone with their ID confirmation service. Once her identity and her address were established she was told that she was banned from all Tkmaxx stores for life and she had to sign this banning notice. She was also given a leaflet from RLP that informed her that she was to receive a notice of intended civil recovery. All the goods were then confiscated and she was given a refund for all she paid for. The whole thing was apparently over in about 10 minutes!

I don’t know what got into her, she has never done anything like this before, I’m angry and she is very embarrassed and upset about the whole incident! She should really know better at her age, she knows that she has to pay for her mistake, but I worry, after reading other similar post here, that RLP will try to charge her an extremely high amount for goods that cost around £20! I just wondered if anyone actually managed to negotiate with RLP to lower the cost of the fine and was successful in doing so.

Also she has just applied for a new job and is worried that RLP will share her personal data (that is what the notice says) with other commercial organizations and potential employers.

hmm can you scan the leaflet for us please, especially the part that says that the personal data is passed onto potential employers.

 

if you cant scan it if you can get to somewhere that will fax it for you i can get a fax number for you to send it to.

Just out of interest, which Tk maxx store was it?

Also why on earth wouldn't you pay? That store will have signs up clearly stating that rlp is in operation. What your girlfriend did was commit a serious criminal act, namely fraud by false representation. Your girlfriend was very lucky not to have been arrested by the police, something that the retailer is still well within it's rights to report. Regardless of the legality of it, rlp does operate a vetting service for potential employers, if it was me and I did the crime, I'd pay the fine and thank my lucky stars I didn't have a criminal record to show for it.

lpi004, yes it was a serious act, this however as it did not involve the police then this person has not been convicted

 

if retail loss is passing these details onto third parties (credit agencies, empolyers etc) as the person having commited fraud then this is incorrect and therefore an offence itself under the data protection act.

 

the other problem with retail loss is that they have been taking the details of many people who either made an honest mistake (which i know you wont beleave but i have seen it done by people), they have also been chasing people who have been cleared by police due to having genuine medical reasons for forgetfulness

 

until recently rlp have refused to accept that there is any medical case that causes people to be forgetful, infact it is only after alot of chasing by people on this site that they have updated the faq to reflect that this happens

Actually I am inclined to believe that there are people who are victims of circumstace. It's mainly for that reason that I risk posting on these forums at all. I just don't like it when people who are guilty (often by admission) of causing loss moan when they are expected to pay for it. As I've stated before, just because no police were involved at the time, doesn't mean they can't be later on. Assuming they had been involved and assuming your girlfrind had been lucky enough to be arrested for theft (of the difference in values) then you'd be paying the goverment £80 for what could be as little as 10 mind work for the officer.

The store incurred loss through your girlfriends actions and you should pay for it.

There is dubious at best legal basis for these private 'fines'. The presentation of the documents as official-looking may amount to fraud. Two wrongs don't make a right. Also, what you are implying about still involving the police if it isn't paid is close to blackmail.

Although it is hoped such discussion will be of use to readers, before exposing yourself to risk of loss you should not rely on any principles discussed without confirming the situation with a qualified person.

Just and update on this - we have received a letter from RLP requesting to pay £130. My girlfriend decided not to pay (probably much to your disagreement Lpi004) , however she wrote back to RLP requesting to provide a detailed breakdown and evidence of the costs and evidence of her wrong doings! This was nearly 2 months ago and we have not yet received a reply from them.

This is not a private fine. It is a victim...the store, sueing a criminal for their losses. OK, i agree the store did have all the goods back, however, the suit is to cover losses of time for personnel or security staff to process this wrong doing.

 

The criminal, and let us be in no doubt, a crime was commited, was lucky that the police were not involved and should pay the costs as requested. Should this matter be taken to court, the amount ordered by a judge, could very easily be more than this particular settlement.

 

Don't be thinking that a company such as RLP are doing this for a laugh, I have seen them take some people to court and force them to sell their home to settle an outstanding bill from a crime. I would settle for a measily £150 against a day in court and appearing in the local rag.
