    • Back to octopus from the smart meter/tariff salesperson. Octopus have now said just ignore the letter - I dont have to have one despite there letter implying (at least) it was required, but that i will HAVE to have a smart meter if current meters stop working as 'their suppliers dont supply non smart meters any more'. I am of course going to challenge that. Thats their choice of meter fitter/supplier problem not mine
    • Point taken that we should inform new Caggers that the £20 option is there in wrong registration cases.  Well, supposedly there, who knows what the PPCs would do in practice.  Anyway, the option is allegedly there with both the BPA as you say, but also the IPC (I've just checked). However, there's a danger here of baby, bathwater. The two easiest types of cases to win are (a) residential - due to Supremacy of Contract and (b) wrong registration - due to "de minimis".  Indeed until recently we has been boasting that no Caggers, over two years, who had sent a PPC the wrong registration snotty letter, had even been taken to court, let alone lost a court hearing. We simply can do nothing about a terrible judge.  The judge seems - I say seems because we haven't had all the details - to have ignored "de minimis",. got fixated on a sign and awarded unreasonable behaviour costs.  A totally bizarre judgement.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am 23, and have about £15000 of debt which is a mix of personal and self-employed debt. I have now, for year either tried to make ends meet by aranging payment plans or by borrowing more and more.

 

I have now come to the end of my tether. I have just had a moment of realisation. I am now unemployed, and claiming JSA, which is only about £200 per month. I have over 30 creditors and just cant cope with all the stress any more.

 

I am, as we speak having to apply for payday loans with fake details just to find money to survive on. My parents cannot lend me anything and I have no other family. I have tried to find work as self-employed but cant take it on because I can't afford the costs I would incur.

 

I am applying for loans and credit with my details and fake details at a rate of probably ten a day I just cannot cope any more.

 

Someone please advise me from "outside the box" because I am going to bed in the minute and hope to god I don't wake up.

Firstly STOP!!

 

It's a bit of debt, fortunately in this day and age, you can't go to prision for it.

 

UNFORTUNEATELY, you can for FRAUD.

 

Whatever you owe can be straightened out. And trust me, it's nothing to worry about at all, although It may seem that way right now.

 

DO NOT APPLY for payday loans.

Without seeming to be too nosey, what are you requiring the money for??

 

If it's to pay debts you already owe, STOP it.

 

We can work out ways to pay or even claim back charges on the debts you have.

 

Take a long minute to just relax, calm down and take a breath.

 

You'll be fine, trust me ;)

I have no support from nobody - absolutely nobody.

 

I have got accounts from railway companies and hotels from being self employed who are due for payment and if they default, i would never be able to go back into self employment in the future.

Even the rail and hotel companies are being hit. Trust me, you'll be more than able to go back into self employment.

 

FIRSTLY and foremost you look after yourself and then your family. IT's that simple.

 

Second, you now have the support of over 250,000 people. Most if not all have been in the same situation as you. We have all had a blip and we are all still here. ;)

 

When you get time, list all the accounts that you owe money to, when they were taken out, what you owe, any charges on the accounts, etc etc.

 

We will help you with each one.

 

Seriously, nothing bad CAN happen to you. So get a good nights sleep.

Hi vtrn,

 

I just wanted to wish you the best of luck and trust me when I say your in very good hands on this forum. I am in a similar situation as you and the CAG group made me realise that debt was not worth loosing sleep over. Please try and stay positive. In this current climate with you being unemployed and you not owning a house, really a creditor cannot do very much.

 

I think this has been a rough year for many of us financialy.

 

Chin up because now things can only get better :)

hey matey think about it, money problems are money problems they can be solved.

terminal illness is terminall illness it cannot be solved.

 

which would you rather have? money problems or a terminall illness?

 

Believe me I lved in the middle of debt for many years and could see no way out, 24/7 my debt lived with me. I got throught it and I am now out the other side, although I do realise it does not take a lot to loose control again.

 

My sister had no money worries but she did have a terminal illness, she is now dead.

Went to sleep yesterday all down in the dumps and woke up this morning feeling better, until I realised Michael Jackson had kicked it. Could life get any worse? Seriously though, I am a bit more focused today on things. Here is a list of my Creditors that are currently on my Income/Expenditure Sheet. IE those I have defaulted on. Some of these debts are so old I have only put down the information I can remember to hand….

· £35.00 due to Travelodge Business Account Card at end of June with another £70.00 due at end of July.

· £145.00 due to Premier Inn Business Account due in the middle of July.

I also have one CCJ, set at £10.00 per month for a Citibank Overdraft and this is paid via Bryan Carter and Co.

Now the debts in BOLD have been really accommodating of my circumstances. The companies in red have been the worst to deal with.

So far, I have CCA'd them already, and had a debt from Freemans written off as well as nearly £400 in charges refunded to my Premier Man Account, then I made pro rata payment arrangements with them all. Stupid me though, as I was telling you I was so desperate I kept looking for credit and adding to the debt.

I cannot provide any more information then I already have given you. I am on here all day now, so feel free to ask as many questions as you wish.

Well done to you for managing to get some debt written off! Any chance you could PM me the letter that you are using for that? Would like to give it a try myself as ive got an old mobile phone bill that am getting nasty letters about. The bill is 4yrs old and I really cant afford it.

Listen to the advice and you won't go far wrong. Caggers are really supportive and not just that, they are also constructive and will try and offer advice and solutions where possible. I think most of us have been where you are at some point - and guess what? We've come out the other side stronger and much wiser :D. You'll have help to sort out your priority debts (those that have to be paid) and the others won't seem so daunting.

Hello. I'm new on here. I've been pretty much harrassed by Roxburghe for a while now and not sure what to do about it. I can't afford to pay back the £580 I owe (from Next) and I'm losing sleep over it every night.

 

I can't even answer my phone anymore. I've had a letter today saying unless I pay the full amount within 7 days, I'll be passed on for further action. I wish I could just write this off, but I'm pretty much living hand-to-mouth at the moment whilst trying to pay other stuff off.

 

It helps a little bit at least that I know I'm not alone in this situation and I've managed to find this forum. I think I'll read as much as I can and work out how to get out of this...

Hi can somebody help me, i took out a car finance with black horse 3 years ago, to cut a long story short i got myself into a lot of debt but have managed to pay most of it back slowly over the last 2 years. The last one is black horse, i have defaulted on payments and they now want the full money. The car is now worth about a quarter of what i still owe on it and i just dont know what to do next.
