for ever - as i said it never goes away there is no time limititon (although i think they might need to apply to the court after 6 years)

 

 

yes,they have to get permission of the court and a good reason for the delay.

 

If its OC there is no time limit for them to apply,but they need original court details,as these are removed from central records after 6 yr.

 

If its DCA

the court will only grant permission up to 6 calendar from purchase date.:D:D

they would still need permission if OP has not payed for 4 years,and they have not enforced.

 

thats why me thinks its with a DCA.

the 6 calendar months is after a clear 6 yr period from judgement date

if it is under 6 yr they would get permission up 12 calendar months from purchase date.

Is there any point at which one could do a cca request , to establish if there was an enforcable debt in the first place ?

depends on what the debt was,if it is covered by cca.

 

is it with a DCA now or oc?

 

presume that if a cca did exist it was signed over 6 yr ago,and oc will no long have it.

 

and could be worth a try,as DCA cant get it:D

 

you say you have not payed it for 4 yr

did you pay anything before that

 

did you know it was registered

or sold on?

 

you can request a cca at any time i believe.

 

as diddy says you will have to give some details of the debt,

ive tried that tack sam he seems reluctant to say the amount or what the ccj if for which makes advising him that much harder

:)frustrating.

Sorry to be frustrating the original debt was originally £800ish , the remaining balance is approx £400 , the ccj was about 7-8 years ago , and there has been no contact for 4 years , Thank you all for your input .

Wait and see ? I don't see the sense in putting my head above the parapet , I will wait for their next move , there's been no contact for 4 years , if I cca them , I will put myself on the radar , meekly wait and murmer not .
