Had a text from a collegue this morning about Natwest changing their T&C's wording to "Enforcement Fees"

 

Anyone else get these?

 

I am off to Natwest later on myself, so will ask for a copy.

Aren't charges supposed to reflect the actual cost of the action?

 

I cannot believe that it costs Natwest £30 to supply a computer generated DN.:mad:

 

We have the OFT test case deciding issues of whether bank charges terms can be assessed for fairness so the answer is that it has yet to be decided.

So could you counter claim for these charges if Natwest take you to court, in order to get the case stayed pending the outcome of the House of Lord's decision?

Oh yes absolutely. It is the one thing I ALWAYS advise if I see that providing the charges outweigh the banks' claim. If not then its a partial admittance and rest to be stayed.

So in a case where charges do not cover the entire debt, you are admiting the outstanding balance, but the entire claim would be stayed pending the HoL/OFT outcome?

Only the part relating to the charges would be stayed.
