Does the jbw group limited have a current credit licence ?

I got this of the oft website. If this is true then why are they still collecting debts ?

For those who may think a application is in for a renewal :

 

Please note. In line with the law at that time, all standard credit licences issued before April 2008 were valid only for a specified period (five years). Thus the Register shows the “Issued” date and the “Expiry” date for that licence. However, where an applicant makes an application for a renewal in good time, the Act says that the previous licence will continue in force beyond its original expiry date. To check whether a licence has automatically lapsed or whether a renewal has been received, and the licence thus remains in effect beyond its original expiry date, see the Licence Status field. This will show “current” or “lapsed” as appropriate.

I have just checked with the oft and they have confirmed that jbw do not hold a current licence and neitehr have they got one pending neither have they filed in a different name.

They used to collect for westminster , why doesn't someone ring them and enquire about their contracts , Jbw is a particulary repellant individual , see him sneering at his 'clients' , for being poor , in 'the Bailiffs' on sky 124 .

It is certainly a serious matter for a company not to have a Consumer Credit Licence if they are enforcing consumer debts. HOWEVER...this is most certainly a very GREY area when it comes to bailiff companies and it is the case that many bailiff companies will argue that they are enforcing an order of the court and therefore they do not need to have a Consumer Credit Licence and this argument does indeed appear to have merit.

 

It is true that the vast majority of bailiff companies do indeed have a Consumer Credit Licence as many companies also pursue OTHER debts that do not require being enforced by a certificated bailiff.

 

Many people on CAG are aware that we are a commercial organisation and indeed we have copies of many contracts between local authorities and the relevant bailiff companies but from a brief look this morning at a few contracts I cannot find that they stipulate that a Consumer Credit Licence is required so I would be cautious with making contact with relevant local authorities at this moment in time.

 

PS; JBW no longer work for City of Westminster. This contract is now with Philips Ltd and has been so since approx September 2008.

Do not forget that jbw also have a debt collection side based in the plymouth area. Unless they are getting around the law ?

Thats a very good excuse nonetheless it doesn't wash with me.

 

Enforcing a court order involve trading in the management of debts. That requires a Category E Credit License. Types of licenses: Consumer Credit Licensing

 

The law:

 

Statutory requirement to hold a credit license: Section 21(1) of the Consumer Credit Act 1974

 

21 Businesses needing a licence

 

(1) Subject to this section, a licence is required to carry on a consumer credit business or consumer hire business.

 

Offence of failure to comply: Section 39(1) of the Consumer Credit Act 1974

 

(1) A person who engages in any activities for which a licence is required when he is not a licensee under a licence covering those activities commits an offence.

Its nothing what we say or know about. Nobody will say anything to them. They could even wind up owing millions to the council and then start up again and the councils will welcome them back with open hands. however unless they have already started to transfer their buisiness to another company and then eventually let jbw go is anybodys guess. That would never happen.

 

A certifictated bailiff collecting parking tickets and council tax must have a bailiff bond - an insurance policy currently with a minimum value of £10,000 before he can handle public money. This is why a bailiff company has to name a bailiff in charge for each case passed to them for enforcement.

Liability for handling public money resides with the certificated bailiff. Many people who are working as bailiffs don't know that, they think the company is in charge.

Is this because of their illegal roadblocks , on WCC strrets , did WCC get cold feet , once they realised the implications and liability they risked ?

JBW were setting up roadblocks?

 

Only on-duty police officers wearing the correct uniform can regulate traffic. Police can do it on behalf of a statutory body such as a council, VOSA and Highways Agency etc, but its never done for a private company unless its for crime prevention and investigation.

They lost their contract with westminister to phillips and more than half of their work force including the chap with the anpr van on the enforcers/cars,cops and bailiff programme defected to them. Several of their main persons have also left over the past few months. Look at this thread which relates to their business development manager :

She comes from a bailiff company which is set to be struck off.
