    • Documents finally arrived today from PRA group.  New day have sent me lots of paperwork, copies of default letters and statements, print out of what looks like a CCA that would have been completed on online, IP address as signature.  This debt is not too old, so possible this is the true copy of agreement ?  Not sure what my defence would be beyond irresponsible lending. 
    • pers i wouldn't.. all you need to know is in the posts of that thread....that being section 127(3) of the CCA refers. if under a CCA return, the 'creditor' claims its a recon, it must not contain any details like a sig, tickbox, or typed name (whether you signed physically or by online tickbox) 1. those are not necessary in a recon, so why inc them? (faked??) 2, it cant thus be a recon!!, it must be a copy of the 'original' from the original creditor, not from a debt buyers filing cabinet. they shouldn't not be 'mixing' some original docs from the OC with crap from their filing cabinet, claiming its ALL a recon! because some of it is faked. just remember there are far more docs like NOA and a DN that are as equally important to a court claim of 'this debt is enforceable'. never rely solely upon the dodgy agreement argument.
    • i have clarified your thread title and your post to make it easier to understand. if you have their engineers report, thats good enough. it will be their decision to repair, refund or replace. but they must under CRA do one of the above. to date how have you been in contacting the manu?  
    • Thank you both, I will make those changes. I have also downloaded the compensation list to add to the evidence and complete the protection bit off their website.  I am going to court next Thursday to deliver the bundle; I will confirm this on Tuesday. I have been to court a few times to represent the military when a soldier is in court, but I will be going. Thank you for all the additional advice. Once I have the whole bundle, I will email it to the admin email. Ill be honest, this is not about the money for me, I do not mind losing that, so I will not be signing a confidentiality agreement.   You guys are amazing

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Has anyone been successful in recovering the PPI payments (in line with the FOS recommendations) from Firstplus after they have received the cashback after 5 years.

 

If so can you contact me because a call to Firstplus has left me very confused because apparantly because of the cashback my balance will stay the same and my monthly payments increased!

 

FOS upheld my complaint and now waiting for FP to come back to me with calculations but I am not that confident they will treat me fairly.

 

Here are all the relevant figures

 

Original amount advanced - £55,000

PPI amount - £13,469.50

Term of loan - 300 months

first payment - September 2003

 

Original repayment - £642.96

 

Original APR - 12/2%

Original MIR - 0.967%

 

Monthly payments did increase to £665.33 (04/04), £677.55 (06/04), £702.27(07/04)

 

Things get a bit complicated because in December 2005 made partial payment of £40,140.44

 

Over same term monthly payments reduced to £320

rised to £351.52 (08/07). Current interest rate is 13.2%

 

In August 05 i had the refund of the PPI policy of £13,469.50

You may have received a refund after 5 years for not submitting a claim

 

but you must check out the fact that your PPI policy would probably only cover you for the first 5 years of the Loan period ie 60 months as your term is 300 months my guess is you will still be paying the interest on the original PPI loan figure of £13,469.50 for the next 240 months and if you check up you will probably find you are no longer covered by the PPI should you require to make a claim.

 

I would write to ask for clarification on this point and if you get any hassle submit a Subject Access Request the fee is £10.00 then when you have all the data on the loan you may wish to cancel it find a cheaper alternative and claim your PPI premiums back including the contractual interest and the 8% statutory interest on top.

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

The reason for my post is that when i spoke to FP on an admin matter I enquired about when they will come back to me - it was during this conversation where they said that due to the rebate of the PPI premium i got back in 2005 this will mean my monthly payments is likely to go up.

 

On the basis the FOS clearly state the customer must be put in the position they would have been if the ppi was not taken out then this surely cannot be right and was just enquiring whether anyone has dealt with a similiar issue.

All I can do is give you my scenario.

 

Cancelled PPI as it was no use. Employer covered me fully and better than PPI through RBS.

 

RBS stated the reduction in monthly payments would not reflect the full amount of the PPI monthly payment.

 

Complained to the FOS, they upheld my two complaints and all of a sudden I get a refund of the PPI premiums paid plus the interest plus 8% statutory interest and yes my monthly payments reduced even more down to the level of repayments on the loan amount as originally described in the CCA. Because of this I also got a refund of the difference between the loan agreement payments and the additional element of PPI that I was told I still had to pay..

 

So make sure you are covered more cheaply, cancel the PPI and at the end you should only be paying monthly payments on the loan amount with no additional element for PPI. ( yet another [problem] to cream off more money)
