question about defaults

I'm helping a friend with some of their stuff they recently got their report back from experian. On it are two defaults. One from capquest regarding a littlewoods account and another from Robway for a capone card.

now he cca capquest ages ago before got his report they sent back letter saying sending back to clients. Now if the default is in their name doesn't that make them the owner and there is no "client" so if they can't produce an agreement they have no right to place a default and should remove this.

 

The second one from rob way is in dispute because of the "agreement" they sent, they go on about clients aswell. If its in their name does this also mean they are the owners and no "client" so are in fact trying it on.:evil:

 

Other than a satisfied CCJ his record is okay just these two defaults, so how can he go about challenging them.

second one is rob way collecting a cap one card account. he sent off for his cca and they sent this http://i248.photobucket.com/albums/gg170/concalmum/gufffromcap1.jpg

 

he sent off a dispute letter, they sent back this is all we have to send blah blah blah, pay up or else. he has since ignored them and I am currently thinking that if they send another demand i may send of the CPR31.16 letter to see if they have the agreement.

 

with regards to capquest this is a copy of their letter sent after the cca request. andynewletter.jpg

 

this is dated march 2009 but on his credit report it says this.

So should he now write to capquest telling them because they have no agreement and said they had closed account details back in march they shouldn't have updated file in May and that to remove the default cos don't have signed proof he said they could process his data.

yep def.

no cca means they cannot process his data.

i'd also contact the cra and tell them the same, their info has to be valid.

they obv did not check the default was legit before they put it on.

 

worth a try.
