    • I told them that it was an accident and that I used the oyster card as my debit card was lost. However, they did an investigation and realised it was not a one off. I have told them how remorseful I feel and how a criminal conviction would result in expulsion from my degree but they still want to take me to court. I have received the court summons letter

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

OH bought tickets for sons to see Bruce Springsteen.

We have no tickets, no reply to emails, no reply to phone calls and no reply to text messages.

Give Trading Standards a call to see if they know anything about online ticket shop as there are a lot of fake ticket sites popping up. Hopefully this one will be legit and you will receive your tickets. Fingers crossed :)

Already spoken to TS who say wait until Sunday, then contact them if no tickets!!!

Had an email today saying that 'Due to the late release of tickets from the supplier you will now be able to pick up the tickets from the venue on Sunday.

We will be contacting you thursday/ friday morning with the collection details.'

Had a little read on a website about the company,someone in same situation as yourself. Someone did turn up at the venue - but they received tickets for poor seating, paid £120 but tickets only worth £40 and ruined the experience. Don't know if this helps any :(

My letter was delivered on Thursday threatening court if I didn't receive my tickets...

Guess what no tickets, no email AND MYPURCHASE DETAILS HAVE NOW BEEN REMOVED FROM THE SITE.:mad:

Do they really think I won't be prepared to take bank statements and my pc to a court????

Don't need to tell you I'm sure keep all emails and notes on phone calls whether answered or not.

 

Are you going to the venue on Sunday to see if your tickets are there?

You may have been given centre seats front row for your inconvinience:D

If the guests are from the onlineticketshop.com, please give me my tickets. If they have also been scammed, complain, complain, complain. Maybe they will be closed down or we can get our money ha, ha, ha.

I didn't mean to give the give the impression that was the solution, for you to just turn up :eek:, I merely meant that a lot of people have been conned that way with the thinking that they had already paid and had nothing to lose, as it seems thats how they operate.

But would they use it as an excuse if you don't turn up for your tickets at the venue then you forfit the right to a refund? :?

Shock horror, full refund:eek: Would have preferred to go to concert, they were still selling tickets at double the price we paid the day before:(

I hope TS get in touch because a lot of their activities are illegal.

If anyone has bought tickets through them check how much they take from you. They have taken £20 to £40 extra from what they invoiced us!!!

I have paid for 340£ for U2 concert in Milan and I have not received the PAID tickets.

I hope that they will give me my money back. :(

Could you please be so kind and let me know what have you written to them... because they don't answer to any of my emails.

Yes, it is quite unussual when you have lost 340 and try to google the site up. Try it sometime, it is a miracle!

And try to google up the nickname, to. Sometimes it is good to know some history facts.

I still hope that I will receive some help with this thing because here in Slovenia I have no idea where should I turn and solve this issue.

As they ignored all my emails and phone calls I sent them a letter telling them that I was reporting them to trading standards and that I would sue them in court for the money if I did not receive my tickets.
