So sorry, i am going to add to all the confussion out there, i will try to make this brief.

 

I am in finance, and the only person in my company who was. I was made redundant a couple of weeks ago and have been given "garden leave" for 4 weeks.

 

Basically, my company wanted me to work less days and of course, take a paycut accordingly. Due to my postion in the company, there was no way that you can hide the terrible situation the company is in. Anyway, although I accepted the day reduction (who wouldn't less work would appeal to anyone!), unfortunately, i could not accept the financial hit, so there was no suitable alternative position available so I took redundancy. I have now found out that there has been a person doing my job on a full time basis recruited! This seems completely out of order to me as that was the reason that the company managed to get rid of me. Also, can a company really hire for my position just yet, as while I am on garden leave, doesn't that technically mean that I do still work for the company?

 

Does any of this sound legal?

No it does not, as it is your role that is redundant not you personally, I'm not sure how you should proceed, however there is bound to be be a forum contributer who can advise.
