I have 2 loans with Barclays, both after April 2007.

Both signed electronically. Neither had a follow-up contract with a real signature.

Are they likely to be enforceable?

Are all agreements after Apr 07 enforceable?

I don't have copies yet. Requested signed contracts but no reply so far.

They are likely to be enforceable but write to them again by recorded delivery asking for the contracts. If and when you get them post them up on here so one of our resident experts can have a look.

As far as I am aware, all credit agreements post 2007 are deemed to be CCA compliant, take a read through this thread for further info.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Hi,

As The Consumer Credit Act 1974 (Electronic Communications) Order 2004 came into force in December 2004 any online agreements entered into prior to this date still need a signed executed credit agreement.

Electronic signatures weren't considered valid until this date.

The Consumer Credit Act 1974 (Electronic Communications) Order 2004

Also it would still have to contain all of the prescribed terms to be valid.

Regards.

Scott.
