here we go again I guess. Missed phone call (nice one Truecall :) ) and they were Robinson Way when I checked the number.

 

Never come across these before.

 

My main question and I never seemt o get to figure our the anser is

 

'are DCAs allowed to contact you by phone when nobody (Original creditor nor DCA) has sent you anything in writing yet stating Company X is dealing with your account or We have told X to contact you.

 

from capital One I have had a general we will set the DCAs on you (no specific name of one though).

 

So are they allowed to phone / contact you without anything specific being sent to me beforehand and in writing?

HI: Be brave. Ignore RW telephone call.

 

Only deal with any DCA by Mail. DO NOT TALK ON PHONE. If responding to letter from DCA do NOT sign - Print your name!

NO, they are not allowed to, it is against the OFT guidelines on Debt Collection

 

PHYSICAL/PSYCHOLOGICAL HARASSMENT

 

2.5 Putting pressure on debtors or third parties is considered to be oppressive

 

2.6 Examples of unfair practices are as follows:

 

© Using more than one debt collection business at the same time resulting in repetative and/or frequent contact by different parties

 

(d) not ensuring that an adequate history of the debt is passed on as appropriate resulting in repetative contact by different parties

 

(e) not informing the debtor when their case has been passed on to a different debt collector...etc

 

Robinson Way aka Robbers Way are well known on here!!!

angrycat - the 2.6 (e) is something I had not noticed / read before.

 

 

 

What are Robbers Way like then compared to other DCAs? have searched forum but getting no real idea of that. Are thy pussycats or trouble?

 

What should I expect? Do they ignore requests to go away / cca / etc etc?

I got rid of them with one letter, saying that the matter was still in dispute with previous DCA/OC....so shouldn't be much of a problem

I sent them a CCA request and they sent me a letter back saying that i would never have received a Credit Agreement for the account they are chasing me for and asked me to keep paying them!!

 

After the Account In Dispute letter was sent they closed the file.

 

I did send them a Full and Final Settlement offer on an account i had been paying for years and they just closed the file. I only owed £12 and i offered £5 to settle in full. Oh well they don't need the money that much.

 

Just ignore the phone calls and wait for them to write to you. They are pretty easy to get rid of in my experience.

I found out Robinson Way paid £29.75 for a Sainsbury’s Visa Card Debt of £8000 with no credit agreement. I am having fun with them.

 

That must be some sort of record, what fraction of a percentage point is that?:rolleyes:

so are Robinson Way in administration or not? seems rest of the company is - why not RW?

Got their letter today. It seems I have 10 days to pay them lots of money or they 'may' etc.

 

It seems that this problem 'will not go away or be forgotten'....

 

Interesting bit of subtle wording there.

 

 

Is an 'assignment' then a letter from DCA to me saying OC has told them to do this or sold them the account saying 'pay up'?

 

Should I not have rec'd this (if that is what an assignment document actually is?) before telephone calls?

 

Actually does anybody know if the OC should be letting me know about RW first or not? Or even at all?
