Hi,

 

I have a very big problem that is causing a lot of anguish in my home and I really hope somebody knows the answer.

I worked in Bahrain for a few months and had an account with HSBC there. I took out 2 credit cards and an overdraft as I had to make ends meet and get myself set up before my salary was all sorted. The job all went horribly wrong and I returned home to the UK without paying alot of it back. This was meant to be our big chance to get sorted and have a happy debt free life. I have been home for approx 18mths, times have been very hard and my wife and I have just been accepted on an IVA. We thought this was us sorted then I got an email from my ex employer stating that HSBC were chasing me for the debt and they would be forced to give them my details. What I would like to know is this debt enforceable in the UK.?? I'm not proud that I have run away from this debt and I have tried to do the right thing in the UK with the IVA (I could have gone bankrupt and as I have no assets it would have been easier for me.) I have no way at all of paying it, I am in a panic and don't know what to do..... please can someone offer some advice.???

Thanks for the quick reply, you are a legend ....... So what does that mean for me.??? Do you think I am going to be chased for this as HSBC are obviously in the UK as well, am I likely to have letters and bailiffs turn up etc.?? Thanks again for the reply, I really appreciate it so much... John

Hey John.

 

I'm trying to find the definative answer on this. My initial thoughts are that they wouldn't be able to bring action against you in the UK as there seems not to be a reciprocal agreement. It's possible that they could try and chase you for payment on an informal basis but I'm not sure that they can employ the legal system. I'm not 100% certain and just awaiting to get an answer from someone who will know for sure.

The thing I am most worried about is the fact that HSBC are a global brand with branches in the UK obviously.... will that affect the reciprocal agreement thing.???

Another silly question.... If it is enforcable in UK will I then be able to add it to my IVA.??? This is a nightmare...........

What was actually stated in the terms & conditions of the agreement. They usually state something about the country of legal jurisdiction in them somewhere.

Looking at that list that sequenci posted it seems that all the countries with reciprocal agreements where all once part of the Commonwealth or British Protectorates & although there was once a Military/Airforce presence in Bahrain I doubt if there is such an agreement with them.
