Can someone have a look at the signed agreement from Shop Direct?Littlewoods and inform me whether you think it's enforceable:-

I Notice that the heading is Littlewoods Flexible Account Card Application - no mention of Credit, and it does say Application.

 

It is a Flexible Account, are the rules any different?

It's a tricky one because the prescribed terms are there at the bottom of the application form and some application forms do become agreements if the prescribed terms are there. The one thing I wouldn't be happy about is the interest rate. It gives you 4 options - which option were you paying? That's not clear and it is a prescribed term. At the end of the day it comes down to what a judge would decide. Would he take a look at this and decide you had had the credit? If they have statements (which they should have sent to you) showing transactions then in my view a judge would rule that there had been an agreement - they have ruled on less.
