I'm posting on behalf of a friend.

She recieved a TFL PCN by post late march

for stopping in a yellow box junction.

She appealed on the basis that because

it was a moving traffic

offence the stills photos on the pcn was

not proof of any contravention.

so no contravention occured.

TFL replied with a NOR and patas forms.

My friend reqested CCTV footage

from tfl but when they did not reply

she panicked and decided to pay the PCN

just before the discount, period.4/5/09

against my advice I must add.

About a week ago she recieved DVD

footage of the 'contravention' accompanied

by a letter from TFL dated 10/6/09

Looking at the footage it's quite clear

that she would have had a good case upon appeal

as her case is very similar to the the Hadfield v TfL

(PATAS case 2080009884).

I told her since she has paid the PCN

the matter is now closed.

I'm just perplexed as to why Tfl have

sent the DVD footage and a letter as

if there is still a process,even though

my friend paid the fine well over a month ago.

They have a duty to provide the dvd under data protection regs even if you don't appeal at all. The PCN doesn't have to prove the contravention took place so it was a wasted appeal the request to view the tape should have been made before the appeal.
