It's been about 6 weeks since I received the CCA (Deemed Enforcable on here) from Cr@pquest, i'm in the process of sending a SAR to check out if I can reclaim charges & PPI & I sent them a letter last week offering £1/ month (I was paying £75/month & have paid off over £1400ish but they can whistle).

 

Today I received the following letter-

Now firstly the amount is for around £2,800 which is £500 more than was stated when I received the CCA & statement of account (which maches the amount on my credit report 6 weeks ago).

 

Secondly I owe LLoyds TSB around 18K on a CCJ that I'm paying off monthly.

 

Thirdly I don't own a home & my vehicle is a 10 year old Ford Escort van of which I'm registered keeper but not owner, my income is carers allowance & income support & I live with my mother as her full time carer in her home.

 

My questions are, is this just the next threat up as I did say " take me to court if you like you'll still only get £1 a month" when I spoke to them last (I know I shouldn't have, but I wanted the 5 minute argument).

 

Are they under the impression I own the home? What agency/searches would they use?

 

If they do make me bankrupt does it include ALL my debts including CCJ's & if so would Loyds let Cr@pquest make me bankrupt? IIRC Lloyds now own HBOS can they take/buy the debt back from Cr@pquest?

 

Any advice & comments welcome

When I found myself in a similar situation, and before I joined CAG I replied to the effect that; firstly I had additional creditors with larger debts so proportionally they would receive a bigger share of NOTHING as I do not own my own home, and all the contents of the home in which I now reside belong to the homeowner (to whom I am an unpaid carer) and finally, I am on state benefits so there will be no disposable income, so neither Court Action, nor BR will bring them any funds.

 

But if you insist on issuing their SD this will be set aside.

Good God.

 

Unfortunate For Them You Are A Gagger.

 

It Could Well Be A Nice Little Earner For You,

 

So You Could Write Back To Them And Advice Them That You Will Be Seeing Them In Court However They Can Avoid This If They Cover Your Cost For Prepaing Your Defence,

 

Who Do These People Think They Are.

Update is that I wrote saying by all means take me to court, you'll be doing me a favour & offered £5/month while I wait for the SAR and decide what my next step is.

 

Surprise surprise they have accepted the £5 a month (down from £75) by return post & again offered a 70% F&F which stressed that they would update my credit file as satisfied with a special flag of partial settlement.

 

So another case of a SD being used as a threat tactic (naughty) & something must be wrong in the paper trail somewhere for them to be offering a discount F&F.

A friend recieved a crapquest stat demand about july last year, as they were financially challenged they never got it set aside and hoped to throw a few more debts on the bancruptcy pile as they had no assets etc. To date nothing so just wondering what is the shelf life of a stat demand?
