    • I took out an IVA in January 2012 however it failed and went to court in March 2013 due to unemployment.  I received a letter from them dated February 2015 with court information (as they took me to court) and stating  ' Further to the failure of the Debtors' Individual Voluntary Arrangement, the Supervisor retained the power to deal with any pending PPI claims and recovery of VAT (where applicable). Any potential PPI monies have been recived by the Supervisor and distributed in accordance with the IVA propsal as modified. However, where further IVA assets, such as PPI are realised after completion of the IVA, these will be realised by the Supervisor acting as trustee of those assets which will be distributed in accordance with the IVA'.   I just need some clafication about this. How long does the Practioner duties last and does this mean that any PPI claims that I may make in the future and awarded will go to the Practitioner for distribution?   Thank you for your help.

    • yea old truecall box. but many phones now have truecall software or akin within.   neighbour has a panasonic set too that has call blocking and 00* works on those too.    
    • Make a counter-offer.   £750 would be out of the question and I doubt they'll provide a free second ascent.  (Unless you could tie it into some humourous publicity stunt for the balloon provider and your friend was happy to do this - "My dream proposal didn't come out but with Cotswold Balloon Safari the sky's the limit!" in the local paper/TV)   Otherwise, what would your friend be willing to accept?  I think he'd be lucky to get £200 absolute max,  so tell the supplier you want £275 - 350 and haggle.   Seriously - what's a realistic valuation of a proposal photo?  I don't know anybody who has one.  The memorable thing here is that it was in a baloon - not that it was (or wasn't) photographed.  I'm often surprised that people miss experiencing real-life moments because they're obsessed with recording them for posterity.
    • What do u thinki  should do , as I think am due an apology for what they have put me through,   as no of this would of happened if the manager done his job in the beginning and  and looked at the pictures I tried to show him of the faults ,I would not have been arrested any help is greatly appreciated thanks

      I bought some clothes online in may through Evans and paid through PayPal
      returned them all seven days later
      I waited the 14days for my refund and no refund came
      I put in a dispute through PayPal but I didn’t get any emails to escalate the case - PayPal closed it. 
      evans said they couldn’t refund the money because PayPal have cancelled the refund because of the open dispute
      I contacted PayPal
      they said the dispute had been closed but Evans at no point had attempted a refund.
      fast forward to today
      I’ve got copies of numerous messages sent to and from twitter messages as it’s the only way I can contact them
      I’ve also contacted their customer service too
      all I get is PayPal have cancelled refund because dispute is still open.
      I have proved that the dispute is closed
      I have got an email saying that if Evans sent the refund they would accept it
      but up until the date I got the email they have not once attempted a refund .
       I have sent them a letter before court email
      I have even offered to have the full refund as a gift card just to get this sorted !
      I’m literally at the end of my tether and don’t know where to turn next !
      i suffer with mental health issues and this is affecting my health and I’d saved the money for a year to buy these clothes as I’m on a low income .

Hi there:)


My simple rule of thumb:


If they can't put what they have to say in writing it's almost certainly because they don't have a leg to stand on and they don't want to incriminate themselves when they bully you.


They are chancing it thinking they can profit from your ignorance.


Report them and send the template letter relating to telephone harassment.

"Fer Christ sake..." - just ignore them.


If you don't owe the debt, you have nothing to fear.


If you DO owe the debt - sit back and wait for them to take you to court so you can resolve your debt issues realistically, and without fear of intimidation by a bunch of third party thugs.


If you start the letter ping-pong, you will acknowledge their 'rights and obligations' and then you'll have to sit back on your potty and wait with intense and receding hairline whilst they try to build a case against you.



Let them sweat, while you get a good nights sleep.

So not confusing at all then... I'm going to wait for any other letters to come through because although i do owe the money, i was under the impression that i was awaiting payment slips so i could pay it off.

I am writing in relation to telephone calls that I have received from your organisation, which I deem to be personally harassing. I have verbally requested that these calls stop, but I am still receiving calls. I now require the telephone number listed above to be completely removed from your systems.


I am in the view that your continued telephone calls put you in breach of the Protection of Harassment Act 1997.


This is a private telephone line, operated on a contract with the intention of receiving and making personal phone calls, I have not authorised any other member of my family to receive calls from your organisation using this PRIVATE TELEPHONE LINE.


By using this telephone number without my permission you are interferring with my ability to use my own private property for the duration of any call.

It is my right to require that this telephone line, which is licenced solely to myself, is kept clear for my own personal calls.

It is consquently my view that you are commiting the tort of interference with contract insofar as for the duration of each call you make to me without my permission, you are interfering with my contractual right to receive and make personal calls on my private telephone line.


Continued interference with my contractual rights in this manner may result in legal action.


If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to the Office of Communications, Trading Standards and the Office of Fair Trading, meaning that you may be liable for a substantial fine.

I meant this letter

You have contacted me regarding the account with the above reference number, which you claim is owed by myself.


I would point out that I have no knowledge of any such debt being owed to yourselves.


I am familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.


I would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.


Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment. This is formal request that you remove all telephone numbers relating to me from your database. You must conduct all correspondance in writing only.


I would ask that no further contact be made concerning the above account unless you can provide evidence as to my liability for the debt in question.


I await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

KH84 - sorry but this is a self help site with advice thrown in, people have offered advice they cant make your decisions for you. so either follow the advice or read more threads to get an idea of what to do
