Marstons and data protection

Hi all,

 

Below is the text of a letter I have prepared today for Marstons debt collection agency, your advice is warmly welcomed.

 

Dear Sir,

I received a telephone call from your Agent, Mr Keith Roche yesterday regarding the non payment of fine issued against my wife Patricia for vehicle registration disc not being displayed on vehicle N290 XJM.

We wish to advise that your Agents call was the first time we had any knowledge of this as we are no longer resident in the UK, we moved to Ireland on November 15th 2008.

The vehicle in question was given to our Child Minder, Ms. Rachel Edge as a gesture of good will in order to help her in the difficult financial circumstances she found herself in.

Permission to use the vehicle was subject to the ownership being changed and the vehicle being taxed, Ms. Edge was also added to Patricia’s insurance at a cost of £160.00, this was to be paid back when Ms. Edge was in a stronger financial position, nothing has been paid to date.

On moving to Ireland, all of our utility billing and financial service providers were informed by letter of our forwarding address.

I understand that several letters have been sent to 12 Stockton View and that a warrant for your Agents to enter the premises has been obtained through due process of the Courts Service, I would be grateful if you would forward copies of all correspondence to Patricia and also a copy of all correspondence from the Court Service.

Your Agent also informed me that my address and unlisted private telephone number was obtained, ‘intelligence’ was the answer I received on enquiring how this had been obtained.

Regardless of the main issue I wish to advise that it my intention to lodge a complaint with the Data Protection Office, I would be grateful if you could also forward me the name of your Data Controller.

Upon receipt of above I will contact the Court Services and seek to have the judgment against my private premises set aside, please also note that any attempt to enter 12 Stockton View will not be tolerated until full documentation is received.

I understand that you are following due process but I trust you will accept that my wife is not going to pay for Ms Edge’s failures without having received any notice of the fine or Court Order.

I will be in Warrington on Thursday the 25th of June and I will be happy to meet with one of your Agents to discuss all matters.

did you infrom DVLA of change of ownership?

No I'm afraid, we gave the documents to our babysitter tgo sort out, we were moving house, job and country at the time!!!!!

Unless you can prove without a doubt that you had given this car to her and that you have emigrated then I dont see a way round this, hopefully someone else will come along with an idea, sorry
