UKPC Parking Charge - In Disabled Space advice please

The lowdown is I was visiting a friend, I parked in a disabled bay as no other spaces were available (there was two disabled bays both empty so i parked in one) There was a clear sign saying about fines etc which I admit i ignored as I was only using the space for a short while, The company is UKPC, they left a note on my windscreen which i found the next morning although it was soaked and completely unreadable. I went home and a few days later received a letter asking me to pay £45 within 14 days or £90 after that with a photo of my car on it. It is on private land.

 

My questions are as follows:

 

1) should i ignore it or pay it?

2) In how many cases does ignoring them completely work?

3) should I send them any kind of letter about the payment request they have made and if they do start with threats at what point should I send them a letter?

4) it's my understanding from what ive read that they cannot prove that I am the driver of the car only the owner is this worth persuing?

5) Bailliffs is this a possibility?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Apart from the moral point of parking in a disabled bay, these marked bays on private land have no legal status whatsoever. So continue to ignore.

I recieved this a a short while ago, I have not yet contacted them in any regard. It states that the "parking charge has not been paid" and It is "now too late to pay a discounted rate" it now stands at £90. I will keep posting everything that comes through from them. Do you think I should be considering contacting them yet, for proof of the driver and that the fine is disproportionate?

Don't contact them. Ignore their fraudulent rubbish.

 

Feel free to forward a copy to you local Trading Standards - play dumb and say you aren't sure whether you should pay it as you are unsure whether it is the result of a council PCN, as it is headed 'Charge Certificate'.

 

Will be interesting to hear what they say.

there is nothing they can do to you

 

you did NOT sign a contract when you used the car park.

thus their 'invoice' is just a windscreen flyer.

I am more than happy to forward a copy to the local local Trading Standards and the council parking dept. I will see if I can find addresses and will do so, if I get any response I will post the result.

 

dx100uk: I have now read this forum in depth and should it go so far as I am forced to make contact I have the letter templates provided by Bernie_the_Bolt, which for others information is here.

 

I dont see it going that far though I expect them to give up.

Bernie's letters are good, but the best thing we've discovered is to NEVER contact them. They want you to write so that they can weigh you up, which is why they have a fake 'appeals' address.

 

If you never contact them you're onto a winner - they get bored sooner, and they won't take you to court (not that there's much chance of that anyway). Too risky doing court - the parking company have no idea who they'd be taking on.

Hi all,

Last week I received another letter this time from Debt Recovery Plus Ltd, This is where it starts to get interesting, I have still had no contact what so ever with UKPC or this Debt Recovery Plus Ltd, does anyone know anything about them.

 

Heres the information on the letter.

 

Debt recovery Plus Ltd

P.O. Box 259,

Ashton Under Lyne,

OL6 0ES

 

Secure Payment

 

Registered Office: 5 Grange Park Road, Cheadle, Cheshire, SK8 1HQ

Company Registration Number: 6774510

 

The letter warns of "intended Litigation before legal proceeding in the county court are issued."

 

"Unless you pay us the amount in full within 10 days or contact us immediately with your proposals for payment our solicitors WILL commence legal action against you. If successful this could lead to a County Court Judgement being issued against you. Enforcement options include:

-Warrant of execution by baliffs against goods owned.

-An attachment of Earnings order (whats this?)

- Your personal Effects being sold to pay the amount at judgement.

The courts will also be requested to award statutory interest, court costs and legal fees which will significantly increase the amount outstanding."

 

"Ignoring this letter will not make it go away. Legal proceedings will follow."

 

Advice on what I should do, do i need to get them to pass me back to the UKPC Ltd as its a disbuted claim or carry on ignoring as its same people?

I thought that "litigation" and "legal proceedings" were the same thing.

"Ignoring this letter will not make it go away". They are correct, ignoring the letter does not make the letter go away. Put it in the drawer and ignore it and it will still be there months later long after the PPC and their powerless DCA friends have gone away. You have been warned ! :) And you will still have the all their letters just in case you wish to send complaints to TS, CSA etc etc. Never ignore their letters, always file them carefully in the 'evidence drawer' and keep them for quite some time - just in case the PPC has a rush of blood months down the line or the letters become useful for a public consultation.

Hello All,Sorry for not coming back to everyone at the time, I just remember I had posted to this all that time ago. I'd Just like to update what actually happened after I posted here.Basically I completely ignored it, the "supposed" fines got larger and larger more companies got involved although it was pretty clear by the end of it they were all the same people. While it was tough holding my nerve, my wife started to get quite worried and the thoughts of baillifs coming around scared her. However I didnt get in contact with them and I completely ignored everything they sent me, this ranged from solicitors threatening letters to various credit agencies. My best advice is to google the people who are persuing you, you can get an idea of how interlinked they all are, use companies house to look up companies addresses in a lot of cases I found these to be the same ie multiple credit companies registered to the same address.No baillifs came and nothing came of it, It did take them over 7 months to give up, I probally recieved around 30 letters from various companies but eventually I noticed no more letters arrived regarding this. At the time I reported them to the local council and trading standard who to be honest were completely unhelpful and just "registered it on their file". My advice is to ignore these companies completely, in my experience no harm came to me.B

Do you mean they didn't kidnap your wife, children, dog, cat, budgie, and publicly execute them?

I've thoroughly read this thread, as today whilst parking in a disable bay at Crystal Peaks Sheffield, I too have received a PCN. The vehicle clearly displays a valid tax disc clearly showing disabled, yes my blue badge was not clearly displayed but it is evident I am disabled. I am happily going to ignore!
